Laurie | Can we get out of a contract with a realtor for "looking" at houses? |
We recently started looking for a house. We called the listing agent on a house we found online and met him to look at the house. We decided to put an offer on the house and he agreed to help us do that but in the "stack" was an agreement to let him be our agent while looking. We signed them thinking it wouldn't matter. Well our offer was not accepted and we are now tied to this realtor for 3 months. The problem is: he has never asked for what we want in a house, I have done all the finding of houses we want to see (occassionally he will send an online generated list of about 50 houses) and even though we both work during the week he is generally "too busy" to show us houses on the weekend, etc. Do we have any recourse for getting out of this or are we stuck for 3 months? We just want to find a home but I was hoping to get a little help and I feel like I am doing all the work. Help! |

Ask the Realtor to cancel the contract. This should be an easy request to fulfill and if they resist, ask to talk with the principal broker.
There are too many good Realtors out there to choose from to put up with someone who is too busy for you. |

An agent is a representative of his/her respective Broker.
Call his/her Broker and ask for a Mutual Release from your Buyer Agency Agreement.

Yon signed him on as your Buyers Agent. Make him work for the money. Document EVERY contact with him and note those times when he failed to meet your reasonable requests. Block out your time frame for looking for houses. Get a copy of the services he was offering. As long as he finds houses that meet your general requirements he is doing his job.
If you find a house on your own it's not his problem, but he is required to do all the work of arranging looking at it and negotiating terms, getting financing, etc. Finding the place is only a small part of the overall job.
If he sends you a 50 house list he is doing the first step. It is up to you to note the ones you want to see. It is not out of line for you to do a drive-by of the ones you're interested in and have him arrange walk-throughs of those that remain on your list of possibles.
It also depends how parsnicity you are. When I had my Buyers Agent I was ready to slap down the money as soon as I found something that struck my fancy.

My wife is an agent and she has these contracts. generally, it only pertains to homes she has physically taken the client to see. Outside of that, she doesn't question if the client wants to go with someone else. You should have your own agent when bidding on a property though. maybe your current agent is not very attentive, but that is just one agent and you should find another. the commission is usually a fixed amount and if there are two agents they split it, if only one, he gets it all. Your agent should be your representative and help you get the best deal he/she can.
You would have to look at the contract, then talk to the agent and explain you would really like to look for another agent if he is binding you to it.
lastly, wait 90 days before looking again. And tell him to fly a kite. |

I agree with the comments from some of the other people. If this person is not giving you the attention you need than they are not doing their fiduciary duties to you as a buyer's agent. At least in the state of Tennessee, you are really a client to the principle broker. He/she should be made aware of your frustrations and will at the very least assign a different agent to you or let you out of the contract all together. Just call the office of the agent and ask for the principle broker. |

This one is too busy, and deceptive. You did not have to sign that contract, only one agreeing that you would have no representation of your own with his listing.
The broker that the agent works for is really the one with the contract, and they should let you out w/o whining too much. |

If he was the listing agent, then you should not have signed buyer's agency with him, he didn't represent you, he represented the seller in the sale. You should just have to ask and he should release you. If this is not the case, call the broker in charge of hie real estate office and explain the situation and they will release you. If you would like to be referred to a GOOD agent in your area, let me know! |

If I were you I would find another Realtor. The only way the contract will come to life is if you buy a house that He/She has already shown to you through another agent. I would say if you are sure you don't want to buy any of the houses you've seen go ahead and go to another agent. It's a buyers market right now and it's your decision. If you feel bad about it talk to your current Realtor and tell him the feelings you have and ask him to either work for the paycheck or allow you to go your separate ways!
