Can we have our landlord pay for the damage?
My family and I are renting a home from a landlord who lives out of state. When we moved in we had a verbal agreement that he would repair the driveway, as the concrete was so bad that there was no longer an incline and our cars were scraping the end of the driveway as we backed out.

He finally put in 4 feet of concrete driveway after a year of us asking. We reminded him that he also promised to put in gravel as the rest of the driveway was dirt and he agreed. After 3 more months he sent a crew out to even the driveway with dirt. The crew didn't return for 3 more weeks and in the meantime we had a major rain. Our SUV was in the driveway and with the newly laid dirt we ended up with very deep mud. When we attempted to back the SUV out of the driveway it slid into the concrete wall alongside our home and scraped the vehicle, causing pretty good damage.

Is he legally responsible for the damage to the car because of the poor condition of the driveway?

My husband knows how to drive in the mud. He goes offroading all the time. Our SUV is a two wheel drive and the tires aren't meant for mud. The driveway is on an incline so it slid...has nothing to do with our driving skills. We have to leave to go to work so we have to move the car from the driveway.

We take excellent care of the house. We have painted, done extensive cleaning, and minor repairs on it. We pay for a house with a driveway and now it is unusable.

Guess we have a slum lord on our hands.

I don't think that you can ask the landlord for the money to fix your vehicle; however, I do think you can tell him in a letter, that his lack of attention to your driveway has caused hardships for you including the damage to the vehicle. If he can't get the driveway taken care of in say 30 days, tell him that you will put in your notice and look for somewhere else to live. It doesn't sound like the guy is a slum lord per se but he hasn't fixed your situation timely either. Will your insurance cover the cost of the damages? Or can you live with the way it looks for now?

A verbal agreement will not stand up in court... since the repairs were not specified in your rental agreement, you signed to rent the property 'as is'.... sorry.

I would say that he is not responsible. There could be a legal argument made that:

1 - he never agreed to the repairs initially and was only doing them because he saw it was needed so there was no negligence for a long standing problem.
2 - the repairs were in process and you should not have been parking on the dirt while the repairs were going on
3 - renters insurance/car insurance companies should battle each other to see who is responsible, unless you are covered for both by the same company.

You can ask him to pay - but a verbal agreement will not hold up in court. Not ever.

Nobody is ever legally responsible for anything that is based on a verbal agreement.

Nope. You have been had. If it wouldn't break your bank, just order gravel yourself and rake it in. Remember, it is your home, his investment, treat it as if you owned it and he will be more likely to work with you.

No. Why would he be held responsible for your poor driving?!?! Get real.

You crashed the SUV and insurance won't cover your stupidity, or it's below the deductible amt, so you're paying either way. Learn how to drive in mud if you're going to live in a house that has a dirt road for a driveway.
