Our landlord has recently told us we were being evicted, and there are no other apartments available in this town. And it has been below zero and is winter. And someone told me that it is illegal to be kicked out during the winter, and was just wondering if it was true? |

Yes, I live in South Dakota and not quite as cold, they can evict you. The landlords only want your money and don't care. I would suggest moving to Seattle, WA as the minimum wage there is $8.55 and here in SD it is hard to even find a $7.50 an hour job, as the min. wage in SD is $6.55. It is very hard now. Or you can try it here in SD but people are moving here thinking it is better, but the rents are really high in western South Dakota. |

The season has nothing to do with your contract. You have to pay rent in the winter, just like the summer. People move in all sorts of weather, it will hope stop you.
It sounds like you have to look for another town though, if this one has none at all. The eviction on your record will make renting harder for hte next decade, rain or shine. |

utility companies cannot cut off heat, but I am not aware of any law preventing evictions to get through the courts. The Sheriff's department may delay serving evictions during especially harsh weather, but that is not the normal course of action. |

"Somebody" said you cannot be evicted.
I have found that "somebody" will tell you all kinds of things - some true, some untrue. I don't know about North Dakota, because each state has its own laws, but the laws in most states are similar.
If you have not paid your rent, you can be evicted. Period.(In every state.)
If there is another reason for the eviction, you will have to check with the state laws, or with an attorney in your stat, but in general, if a landlord wants possession of his property, he can evict you, within certain guidelineeswhich usually differ from state to state..

I say no, by law you have to have minimun notice varying from 4 weeks to 6 months.
If all else fails change the locks lol

I think it is illegal, you might want to check it out and make sure but I am pretty sure in the winter months in colder states its illegal. |
