Can you be reimbursed from the landlord if you erect a garage on their property?
The person was paying half of the morgage,but his name was not on the morgage. He build a garage on the block plus other bits & pieces, but when he died she said he was renting from her. There are no rent reciepts but money was going into a joint account, which he didnt see any statements of it. There was no sexual relationship between them.

No reimbursement and the garage is the legal property of the land owner. Any structure built instantly becomes the landowners property, even if the renter were still living.

Sex has nothing to do with anything and is not relevant in any way.

Any changes to the property must have the owners written approval and building permits. There is no reimbursement and besides who get the money??? Certainly not the mortage company...

If you do not own the house and did not get permission from the owner to build and that you would be reimbursed if you did then no!! They have no rights to make any changes that are not in the lease agreement, and if they do they could have gotten in trouble for it..

No. Unless there was an agreement in place then no reimbursing will take place. You can build another house on his land and legally it 100% belongs to the homeowner, unless you have documentation stating otherwise.

Unless you can come up with some proof that the landlord agreed to pay for this (doesn't sound like they did, and even if they did - where is the proof) then nobody is going to say the landlord must now reimburse this.

Sounds like they did this to be nice and for their own use and never expected to get paid anyhow, so that is what a court will assume unless you can prove otherwise.

If it is not in writing then it will not stand up in court.

Basically, if you watch the court shows or have ever been present in court when it involves disputes of money or property the judge expects written documentation such as reciepts, an agreement signed by both parties / validated or notarized, financial statements, etc. In this case - based on the information you provided there is not documentation for that. If the house is in the name of that person - it is of course their home which they can allow some one to stay as a rentor / in exchange for working around the home and other properties / or for free. The money going into the joint account is not stipulated or validated unless there are reciepts - all that would substantiate (dependent upon the amount put in there monthly by the deceased person) is that he rented from the person and resided within their home.

The person could stipulate that he gave her a certain amount and she took care of bills, rent, food, and utilities out of that account.

If there is nothing in writing on the garage then it was something the person chose to do within their own means and it may have been accounted for through reduction of rent or some other concessions.

Unless there was a written agreement between landlord and tenant for payment for improvement, any "permanant" changes automatically become the property of the landlord IF the landlord wants them.

If the landlord doesn't want them, the landlord can pay to have them removed and sue the ex-tenant for the removal costs and for the cost of restoring the property ot the original condition.

I am not a lawyer, this is just what I have been told about relationships like this during my 30 years in the business.

Real estate is all about written agreements. If there was no written agreement between them about this then the written agreements that do exist are the ones that are enforced.

She still has to make the whole mortgage payment, she still owns the whole house, and she has to take care of the property.

She does not have to prove anything. If you believe you have some claim on this property then you are the one that has to prove something...not her.

Unless the person's name is on the mortgage, he's been paying rent.

If his name was not on the deed, he had no ownership in the property, and most likely built the garage for his own benefit while he lived there.

Fixed (that is, attached) and substantive elements of a property become part and parcel of the property, no matter who builds them. Unless he had memorialized on paper an arrangement with the owner regarding the garage, it is part of the real property.

Only if the landlord agreed to his building the garage can he be able to deduct from the rent. It would depend on what the agreement between them was and, since such an agreement would involve real property, the agreement would have to be in writing in order to be able to enforce it.

Why would sex have anything to do with it?
