Can you break a rental agreement for a good reason?
My family and I just moved in about 3 months ago to an apt. the lady had us sign the papers before we saw the apt. but that's not the problem. We signed a 1 year lease and than as soon as it got cold like the middle of the 2nd month we started getting mice. I have never lived with mice before and they are driving me crazy. Im very scared of them and the hole apt. is infested with them. I stayed awake last night just listening to the one in my closet. I cant live here is this a good enough reason to break the lease with no legal issues?

Also I have told the manger she gives us mouse traps stickys but cant use the little things they eat because i have a dog nothing works....and she says thats the only thing she can do...i have also asked my nextdoor and he has them also!

That would be legal grounds to break your lease since she is not doing everything she can do eliminate the problem. She needs to call an exterminator.

Give proper 30 days notice so everything is legal.

Note: If she had called an exterminator and was doing everything possible, then you would not have grounds. Just so that you know.

EDIT: Those saying the tenant is not cooperating are wrong. There are certain baits that cannot be used around dogs. You guys want her to risk killing her dog because the stupid b*&#h is too cheap to pay for an exterminator?

Contact your local code enforcement office. They are part of your Town, or City Government. Where I live they will fine a landlord if they don't actively fight pests. Mice can create health hazards and be detrimental to your health.

I would break it, and if they threaten to pursue you I would contact the local Health Dept., and the city you are in hopefully has like a Buildings Commissioner whom may be able to enforce some kind of city law (code) for having such a premise for rent in the 1st place.
I wouldn't think any court would ever go against anyone seeking refuge from such uninhabitable living quarters.

Mice aren't a reason to break the lease. Call your landlord and tell her about the mice. Or just buy a couple of mousetraps. They're nothing to be scared of - they're just a minor annoyance to be dealt with.

Well, i broke mine yrs back for a military operation. I was protected by the soldiers & sailors relief act. If the mice are the only issue against the apartment I'd force her hand to get them exterminated. Otherwise you may have to take her to court for paying pest control and/or getting out of your lease (there will be future problems).

Maybe. An house must provide livable conditions. Mice might qualify as creating unlivable conditions. You should ask the landlady to fix the problem. If she won't or can't, you may have a reason to file a complaint with the housing authority and/or break your lease.

Generally NO. READ you lease. AND never, never sign a lease before seeing a place.
Get several neighbors to sign a letter or petition to LL to get an exterminator in to the building. The basements and laundry areas need to be treated, not just the apartments. It's common for mice to come in as it gets cold. Having pets, and pet food in the building makes it more attractive for mice. The whole building needs to have the mouse issue addressed at same time.
And you're NOT doing your part by not putting down traps, making excuses about your dog. Figure out a way to do it or stop complaining. Be part of the solution!

A contract is just that-a contract. If there are mice, you need to tell the landlord so they can take care of it. If she won't she might let you break the lease, but often times they will make you pay a large sum such as the amount of rent that would be paid had you stayed until the lease was up.

Oh and set up mouse traps... at least it will cut down on the amount of mice in the mean time.

it gets messy..you have to complain in written letters to the landlord and the owners of the property, then you have to write letters your housing authority so they can make an investigation. it's alot of hassle but you have to work within the system

Better to contact your landlord and get them to sort it out. If they don't then you stand on firmer grounds.

well if you break the lease its a breach of contract. you need to have your landlord fix the problem. if they are unwilling to do so then you should speak to a lawyer on exactly what your options are, they will vary from location to location. though you may be able to break the lease, i wouldn't count on it.
