You can pay for the repairs then sue the landlord for reimbursement. You need to notify them in writing, ahead of time, that you plan to do this, so they have one more opportunity to correct the situation themselves. |

If you go thru the proper procedure, yes.
You first need to send them a certified (so there is proof they got it) letter stating the needed repairs. They then have 30 days to get it done. If they fail to do that, THEN you can get it done by a licensed contractor and take only that amount out off the rent. Make sure to keep receipts and give copies to landlord.
This only works for health and safety issues. General non life threatening repairs are strictly up to the landlord. |

Not legally in most states. If the LL fails to do necessary repairs, most states Tenant LL laws provide penalties. You still have to pay the full rent, but can sue for penalties if repairs aren't performed in a timely manner.
Check your laws, it may be a cash cow to you if the LL doesn't do necessary repairs in a timely manner. |

READ your lease, check your state and community LL/Tenant laws. In most places it is NOT permitted. Have you made written requests for LL to do repairs? What is LL's response? Just because YOU want something repaired does NOT mean LL has obligation to repair it. If it is health or safety concern, then LL should repair it within a month of request. |

No, You can not. If you feel you are eligible for some sort of compensation, Place your rent in escrow and file a Landlord Tenant case in court. Let the Judge mediate the maintenance and the rent. In doing this you make the landlord aware you are not going to tolerate bad service at the same time you are being responsible for rent payment. Holding rent back shows that maybe you didn't have the money and were doing this as an excuse not to pay.

If your state is one with a repair and deduct law then yes you can go through the proper procedure as far as giving them advanced written notice and allowing time for the repairs to be done and if they fail to do so then you can deduct the cost of repairs from the rent and give them copies of any invoices / receipts and the remaining balance of the rent. |
