Yes, you can get evicted for non-payment of rent. Security deposits are a separate deal, and you wouldn't want to risk losing that much money.
Get your rent current and then talk to your landlord if you are having trouble affording the place, need to move because of a job change or whatever. You can't negotiate if you are in default.

well it depens on if part of the money was for the deposit

I'm not sure why you've paid 5800 over a three month period when rent is only 1000, but yes you can definitely get evicted. Try driving by an apartment complex on the 6th day of the month to see former residents "stuff" out on the street.

You didn't mention how much of the 5800 is for monthly rent versus deposits, so it's difficult to assertain if you really have paid ahead. However, if you do not have any rent due currently, there would be no reason to worry about eviction for nonpayment.

Jay
If you lived there for 3 months and paid $5800, then you're most likely paid up. No?

Unless part was deposit. But 3 months @ $1000 is $3000. A $2800 deposit seems steep.

But, yes, as soon as you fail to make a rent payment, you can be evicted.

Do you have proof you paid rent? Cancelled checks, money order stubs, etc.. If so, then I would take it to court. If not, then there is a good chance you can. A landlord can send you notice, if it is in the contract, giving you notice to move within a normal amount of time. 30 - 60 days. I am a landlord of 2 properties, all of my contract state 90 day notice will be given. I have never used this notice in the 5 yrs I have had them.

If rent is $1000 so far you would of only paid $3000. Why would you pay more than that, unless you are including the utility bills and deposit?

Johnny
Well yes of course you can get evicted for not paying rent but I don't understand the calculation.

Rent is 1000 x 3months= 3000 and you paid 5800 ???
Looks like you overpaid to me

If you have only lived there 3 months, you should have only paid $3000 in rent. Is the other $2800 for a security deposit? Yes, you can be evicted for nonpayment, but it usually won't start until you are over one month late. But, that depends upon your landlord, and should be spelled out in your lease.

kitty a
yes but you should be fine for another 2 months unless thats a typo

OK...why are you asking about eviction since you've already
paid $1000 a month times 3 months equals $3000.
Leaving $2800.

could it be that the remaining is $1000 security deposit, last months
rent for $1000 and maybe a pet deposit, or a deposit for chaning
wall colours, redecorating, something to that effect. I don't under-
stand you don't know what you paid for.....

do you have a lease?
