Can you get the keys to a new house before you actually complete - to move things in if the house is empty?

Yes you can. It's called access on exchange and before completion. Tell your solicitor what you want to do. Explain that you will take on board all costs when you receive access (insurance, utilities, etc). It's a really useful tool in development ... if you get access prior to completion then you get to refurbish the property without paying the mortgage so it increases your margins.

Not usually, unless you do a short tarm rental agremeent.

Mike
Nope... unless you get some sort of short-term lease.

You dont own the house til you close... and the deal could fall apart at any time til you sign the mortgage.

Zippo
Yes its possible, although there is clearly the problem of insurance and things.
It has to be a special agreement between the buyer and the seller, which is normally formalised by the solicitors involved.
If, however there were to be a problem, before completion, the legal battles could be pretty difficult, over what was left etc.
When I sold my house some years ago, out of which we had already moved, the buyers not only wanted to move some stuff in, but even to have some work done on the house.
The agreement, reached, allowed them to do it, but also stated that if they were then to pull out of the sale then they would not be able to reclaim anything from us for the improvement that they had paid for.
If we were to gazump them then we DID have to pay for the work done.
Anyway, make sure its all detailled in a secondary contract, or you could be setting yourself up for trouble.
And of course your solicitors will be too pleased to have you pay for the extra service.
Good luck

We did have a copy key before our house was completed. We had to get people in to do floors and tiles before they could finish it so it was very handy that we could check it each evening to see what progress had been made but generally the keys are handed over when the sale has closed. You could ask the foreman for a copy, no harm asking.

No. It's all down to insurance at the end of the day. If you move stuff in before the completion you insurance will not cover it, it will be covered by the people who still own the house.
So basically if there was a fire or a flood thier insurance would have to pay for it.
So nobody will take that risk

Classy Granny
You generally can not have keys until the closing is completed.

No as you have not signed the contract and monies have not been exchanged so in theory the property is not yours

Its all up to the seller. I actually had the movers arrive and unload my goods before I closed on the house.

Very unlikely - once you are in where's the incentive to complete the purchase? Your seller might let you deposit some things there under supervision but won't let you have the keys to make sure you leave when you're done. If you don't complete the purchase then it's you that's lost your stuff.

kumala
in theory yes, but it hardly ever happens

bellendme
ask the seller i did and they gave me a spare
key as the house was empty
it was handy when i wanted to take
measurements.
you don't ask you don't get.
so ask they can only say no.

Searchlight Crusade
The answer is actually yes - provided you negotiate occupancy with the current owner, for which there will likely be compensation demanded.

If your transaction fails for any reason, though, expect there to be complications. Probably better to wait if there's any doubt

I've been involved with an illegal occupancy suit due to illegal actions that a prospective buyer pulled on a vacant property of mine - and then it turned out he couldn't qualify. No fun for anybody involved, and it cost him a large chunk of change.

linda
generally NO, until the "final" inspection and a safe to occupie certificate is issued you can not .

Bob D
maybe but if anything happens, there are legal issues and thought it is tempting. Give yourself more time at your old place.
