It's correct that you do have to pay, but I don't think you will be going to jail. They'll get their money one way or another. Even if they have to go as far as garnishing your wages. |

Definitely no jail, so don't worry about that.
I actually once lost an investment property because of some mistakes I made. Was able to do a deed in lieu with the lender and thus it had a hit on my credit, but I was able to walk away from the property.
I don't think you can automatically assume the bank will come after it's money. Most likely, the house didn't actually sell for that amount and your primary lender bought the note back for a higher amount. A lot of it depends on your mortgage documents. Some people right now are losing homes that they never should have been able to afford in the first place. A good attorney can help you figure out if you fit in that category. You can then make a case that it was the originating lender's fault and not yours. Sounds fake, but I've seen it happen.
Lastly, you most definitely will get hit with a tax bill. If the bank let's you off from paying it, the feds will count that difference as income so be ready to pay the man.

NO....you won't go to jail. You need to check with a Bankruptcy Attorney. If you can go Bankrupt on this, then you can go on with your life afterwards. |

you won't go to jail because you are broke, however if the lender decides to go after the money you owe they can garnish your wages if its legal in your state or they can freeze your bank account or any money account. if you want peace of mind it's probably best to file bankruptcy. a good attorney will give you a free consultation and let you know what is the best option for you whether it's a chapter 7 or a chapter 13. the difference is that a chapter 7 you pay an attorney fee and all your debts are wiped out. if you choose a chapter 13 you pay no fee but all your debts will be consolidated and you make monthly or biweekly payments for about three years and than your case gets dismissed.
i would advise you to take the chapter 7 so that all you debts get wiped out and your case will get dismissed within three months instead of three years like with ch.13.
you will sleep better at night and starting over is easy.

No, you can not go to jail for not paying a debt. You can have your wages garnished, any additional property or assets seized, your tax returns can be withheld, and other things can happen. However, many, many loans currently in default where the result of mortgage fraud, lying about income, assets, or credit history on a mortgage application is mortgage fraud which is a felony in most states. The federal government is looking into these types of cases currently because of the increasing frequency of the crime over the last few years. You are liable for the difference of the loan but only for the statue of limitations to collect on a judgment in your state. At minimum sit down with a credit counseling service asap and speak with a bankruptcy attorney regarding your situation. |

No , we don't have debtor's prison.....but what it does is forces you into bankruptcy....which you have to file ....you do owe the difference, but the bankruptcy absolves you from owing it.
This ruins your credit for awhile.....but you can rebuild it later.
There are different types of bankruptcy...so you need to find an inexpensive lawyer who just works on these kinds of things.
They can advise you what to do...you can make an appointment and they won't charge you much, and then a fee if you decide to file it.
But no...you don't go to jail.....but you will be hounded for the money....so for a large amount like this, bankruptcy is probably what you will have to do. |
