Can you help settle a difference of opinion?
My BF bought a house,we moved in together a year ago.History: The MTG. pmt every month is 732.00 - this is not including taxes & Insurance, he pays this at year end. The Issue: I pay him 500 a month. not to include bills, this is another 250-300. one month i saw that the MTG. was only 732 not 1000 which is what he told me it would be, I asked, why I pay 500 a month if the MTG pmt is only 732. when 1/2 is only be 366. His response: 500 would be 1/2 the MTG IF taxes & insurance was included in the MTG pmt. My issue: I don't think that I should be responsible for Taxes & Insurance, because (in his words) this is not OUR house its HIS house,. His Response: he says I don't pay 1/2 the MTG + taxes & insurance, I pay Rent. (as if I'm a tenant there) he says: I'm not seeing the BIG picture, if something breaks in the house, he is responsible not me. My responce: YES he should be responsible for damages, IT'S HIS HOUSE! So in my opinion I should pay the 366+bills. so what do YOU think?

You may want to consider talking to a real estate attorney as your individual rights. If your paying 1/2 of the housing expenses PITI Principal Interest Taxes & Insurance. There is equity being built.

Perhaps a simple partnership in writing can be established if something should go wrong in the future.

The both of you would then have an understanding.

Did he place down with the original purchase a downpayment?

It appears that both of you have solid points and it appears that it goes beyond being a tenant in the house.

I think that you need to pay for for your share of the taxes and insurance, but he needs to give you equity in the house also, and a 1/2 the tax deduction for mortgage interest, taxes and insurance.

Most mortgage payments include an escrow account for taxes and insurance.

You may also be able to claim common law marriage, and entitled to have the house, depending on the laws in your area.

Your boyfriend is correct. Regardless of when he pays the taxes and insurance, they are still a monthly portion of his housing expense. If you are splitting the cost of the housing, then you should pay half as agreed. Additionally, if you agreed to pay $500 per month to live there, then it doesn't matter what he does or doesn't pay, or even when he pays it. your obligation is still $500.

Is $500 reasonable rent in your area? If so, you have no right to complain, regardless of what his mortgage paymeny/taxes/insurance come out to.

Bottom line, you shouldn't base your payment on being 1/2 his payment. It should be based on market rents. BTW, you ARE a tenant.

If the agreement is to pay half then it should include taxes and insurance, but not any principle as that is not a cost but merely a transfer of assets from a cash bucket to a real estate bucket. So if the total is $1,000 a month as he claims and $100 a month goes toward principle you payment should be $450 (half of $1,000 - $100). See how well that works out - a compromise between $350 and $500.

Since it's all about "opinion", as you say, my opinion is that you stop calling him your BF, get some Ben & Jerry's and the apartment listings.

Try not to take it personally but chalk it up as experience. It's not you. It really is him.

If you moved in at the same time, and paid every month, then you have been helping build as much equity as he has. You should listen to the advice I saw someone else posted and find out what your options are. You should tell your boyfriend that it IS his house and he can pay for it unless he wants to add you to the title. To do this, all you would need to do is go to a local Title company, and have a "quit claim deed" done to add you to the title. Then it belongs to you both, and you both build equity. Tell him if he doesn't like that idea, you won't pay a dime.
