Can you negoiate price of a real estate property after you sign a buying contract?

Rules can vary. Ck with your agent.

If the contracts are not exchanged you can withdaw your contract and submit a new contract at a different price but you better withdraw it right away

goz1111
It depends on the facts and the contract you signed, but in general if you sing a purchase agreement that had certain conditions within the offer like inspection and damage assessment

and as is the case in general the place does not inspect under the conditions of the offer then you can terminate the offer without recourse and submit a new offer

but you will need a just cause under the contract to negotiate the price you offered in the contract

The responders have given some excellent advice. I suggest you rephrase your question adding some additional facts that are material to whether there has been an offer and acceptance. It is not clear from your short question just what the exact facts of your case really are.

You can try. If the seller is willing to reopen negotiations you can do it. But, it is not likely. All negotiations are done prior to signing a buying contract commonly called an earnest money contract.

sillystring1010
Not usually, unless you put in the contract an inspection. Then if there is something wrong with the house, you can negotiate.

ibu guru
You negotiate before the contract is signed. Once the contract is signed by both parties, the price and terms are set and the parties must perform as agreed. If you renege or try to renegotiate now, this is bad faith and it will cost you.

in most instances no. you would have to back out of the sale, lose the earnest money, and then make another offfer, in which they could deny.

The rules vary state to state. In my state Oklahoma you submit a contract with your offering price if they except then they sign. If they do not sign they either counter offer or say no deal. Once both parties agree to the contract it is done no more negotiations. The exception is if the inspections reveal a problem then you can renegotiate of cancel the contract.

In CA, yes if you are within your contingency period. I think it's 10 days from execution of the contract. I don't know what the answer is for other states. Maybe you should post the state you are in?

No you cannot do so. if both the seller and buyer are willing they can do so even after signing the contract. otherwise it is not possible in any way.

This is a question for your Realtor, who will specialize in the legality of your issue in your area, as it differs from place to place.

Unfortunately I can't answer your question because I don't know where you are located. Is this before or after the offer has been accepted? My guess is no.

However, here in BC, Canada - you cannot really renegotiate the price after the contract has been accepted unless you mutually sign for changes. This is NOT taking into consideration any conditions precedent on the contract [also known as "subjects"]...which if the subjects cannot be removed, depending on what subject is it - the sale price may be affected.

However during the offers/counter offers yes you certainly can!

godged
Maybe, depending on your basis for requiring a contract revision. If it is an inspection or appraisal problem, this could be fine. But if you are getting cold feet, expect to lose your earnest money.

Hopefully the agreement of sale is contingent on various inspections. This could be termite and wood infestation, radon, lead and home inspection. Usually there are also several options.

For instance on a home inspection, you may have agreed that you would go ahead with the purchase if repairs do not exceed $1,000. You can re-negotiate if repairs exceed this amount. Another option is considered a take it or leave it. If you chose this option, you should be able to negotiate repairs and quite often buyers prefer to do their own repairs. In this case you could ask for a lower sales price or a credit back at closing.

Just be careful, though, because your lender will probably want to see a credit go toward closing costs and there are limits depending on down payment. Also, they usually do not like to see credit toward 'repairs'. They are protecting their interest because they don't want to lend money on a home that needs repairs.

If you have a Realtor who represents you as a buyer's agent, they should be able to answer additional questions and help you with negotiations, if possible.

yes i believe so.. If something is wrong with the house that was not before you feel the price should be lower then tell them at closing that you want them to put more money in escrow..

Assuming that something went wrong in the process. IE The inspection brought up major concerns or the bank appraisal came in lower than the offered price of the home.

Yes, re-negotiations can happen. But if there are no reasons for re-negotiations, then no.

if you made your offer conditional on a home inspection, then all deals are off, if you find even the littlest thing wrong, you can negotiate the price based on that defect.

Kind of unethical, but totally optional.
