Can you split a mortgage?
I am not married and this seems like the best way to protect an investment. For example, if my boyfriend and I want to buy a condo for $300,000 can we each have a mortgage in our names for $150,000 less the down payment?

no you cant. a loan will need to secure the property in the FULL amount. no lender in their right mind would take half interest in the loan.

there is no such thing as a split mortgage.

easiest thing to do is get the loan together (as co-mortgagors, co-borrowers refer to married people) and have title vested as joint tenants. this will give you each 50% rights to the property and neither of you will be able to sell or refi, without the others consent.

No, this cannot be done. Since you are both purchasing the property, both of your names will appear on the Deed. This means both of your names will appear on the Mortgage. After closing, the lender will receive a lender's policy of title insurance, which guarantees that they have the first, best lien on the property. If there were 2 separate mtgs for 2 separate people, this would not be possible.

If your name is NOT going to be on the title, you cannot get a mortgage for a purchase in your name.

I would seriously reconsider purchasing property with someone that you are not married to. Keep in mind that you have ZERO legal protection in the event that he defaults...married couples can get a court to enforce who pays for what...you can't do that if you are just live-ins.

You have no more rights that two unrelated people that purchased a property together...and that is a MESS when things go back.

Just remember that nobody buys property together thinking that they will ever break up.

I've never heard of that, but I would check with the financers. They would answer the legal aspects to a couple buying property. Oh and have a lwayer involved. You may be in love now, but later on down the road you could need to protect yourself.

I would think that this really depends on where you are purchasing the property.

In Australia if two people take out a mortgage together they are considered jointly and separably liable - meaning the bank can chase either one or both of them for any unpaid monies. I know this from bitter past experience.

Logically it would seem to me that many Banks would refuse to provide two separate mortgages in two different names as this would make recouping any unpaid monies more difficult.

Maybe some real estate moguls out there will be able to help you,

Ehhh, you can own the property 50-50 and you can be on the mortgage 50-50. The mortgage company is going only want one mortgage on the property.

I'm not really sure that would be a good idea or if it's even possible. Most people that buy property together will put the whole mortgage under both names. If you can split mortgage on a property then make sure you have all of your i's dotted and t's crossed. If he defaults on his half of the mortgage then I'm pretty sure you'll lose the property. I would check with a financial advisor and/or a mortgage broker (lender) before taking the plundge into property bliss. That takes extreme trust on both parts to buy something on that large of a scale together.

No, you cannot "split" the mortgage as you describe here. But, you can use both of your names on the contract for the full $300,000 amount. One would be the "Borrower" and the other would be the "Co-Borrower".

I would not buy any property with someone I was not married to, but yes, you can do that. You can vest as joint tenants, or 50% interest each, either way.
