Contract was sign to sell our house. Photos were taken. After 1 week, it is not in the market. Please advice.?
It was signed August 7, 2007. By August 14, we tried to call the estate agents 3 times and they said, they will send somebody. Then, they called and sent a couple to view the house (Mr. & Mrs. Russi). what I was expecting was somebody to measure the house not a viewer. August 16, 2007, We received a letter from the Estate agent, saying that, they enclosed a copy of the sales particulars. But there was NO PARTICULARS enclosed in the letter. They also need us to provide a full driving license or passport as an evidence of identification from anyone selling a property as require due to money laundering legislation. My husband went to the estate agents office to give them a copy of his driving license but it was close. After calling the office several times, they answered. They told us that the manager was ill, and she will then find out where the Sales Particulars is and will call us back. Can we cancel our contract and look for another estate agents? Proof of ID should be provided before they take your instruction.

They cannot advertise or give out 'full' sales particulars until you have approved the contents. This includes measuring (if part of their service).

The viewer was probably a 'mate' who was sent round to keep you happy.

Think of it this way - if the office isn't open for you, the client, how on earth are buyers supposed to make enquiries.

As for the contract - tear it up, they are not fit for purpose. Appoint a reputable agent, preferably a member of NAEA, RICS and Ombudsman for Estate Agents.

What a rubbish estate agent. Get advice from a competitor in writing & see your solicitor. From what you've said, they don't seem to be fulfilling their part of the agreement.

Sounds like your agent or agency is operating alittle slow. I would read through the contract to see what the specs are on getting out of the contract.

If you are paying someone for a service, you should be receiving it. Some other agent would be more than happy to ensure that you are serviced.

Dump these losers, and fast. There are too many shortcomings in the way they are conducting their business. Something's not legitimate here. If your state has a 10-day cooling-off period for contracts, use it today. Even if not, then notify them in writing that you do not wish to be represented by them and cite the problems you've had. A reputable concern will let you out of the contract. If you signed an Exclusive listing, you may be in for more headaches, because your property might not get into the multiple listings. It seems like these guys are trying for identity theft, but that's only my suspicion. If they say they'll cancel the contract, but that they're entitled to " out-of-pocket " expenses for the photos, or whatever, get it all in writing, and pay them as long as a reputable realtor tells you the charges aren't exorbitant. You do have solid grounds to break the deal, so be firm and get everything in writing. Good luck.

If you didn't sign a "sole agency" contract you can instruct a new agency to work for you. BUT check the small pring, if you have 2 agencies and sell through one the other can still charge you nominal fee for doing "work" for you.
Just check the contract carefully.

If your contract says you can cancel then you can. Call them and let them know they have 1 day to get someone out to the house or you will be relisting with another agent. If they say you cant your in a contract, Tell them you will take them to court over their shoddy business practices. Their choice come do their job or lose a customer.

Give them the Donald Trump, 'You're Fired!' and do it pronto! If the start is like this, imagine how the whole process would be. Cut your losses while you can and find another company. Read your contract for details and if it is not in your favor, contact your lawyer. Real Estate is a service based business and this company you are dealing with has no class!

Check and double check your contract - at the very least I would complain to the branch manager and go from there. if you can get out of the contract I would recommend you do so and put your house on the market with another firm. Good Luck.

I would definitely have no confidence in this agency. I would put your grievance in writing and explain that, even though you have signed a contract with them, you feel they are not upholding their side of that contract and you find it totally unacceptable. Give them xxx number of days to rectify the situation and show that they are competent enough to deal with your house sale, or you will place your property with another agency who is willing to show they can be trusted. Address your letter to the manager and wait.
