Could raising my rent (or refusing a lease renewal) because I'm pregnant be considered discrimination? ?
It's that time of year (lease renewal) and I have an uneasy feeling. I don't want my landlord to pull any funny business because I'm pregnant. He already informed us that the rent will be going up because of taxes and water. He also told us that he is very happy with us as tenants, and he would be happy to renew the lease...but that was over the phone. He doesn't know that I'm pregnant.

We have a two bedroom apartment. It's my husband, daughter, and myself with one on the way living in the apartment. It's not going to be cramped at all.

the LL has the right to raise the rent at the end of your renewal term regardless of your family situation. It's standard practice with LL's to do just that. He cannot discriminate against you for being pregnant or even having kids, Familial status is against the Fair Housing Act along with race and disability. If you showed up to rent and he refused you and your credit was fine and you qualified then you'd have a law suit. If he's happy with you then he'll renew you, he cannot change his mind because you are pregnant.

A 2 bedroom is fine for you, your husband and two children the standard rule is 2 heartbeats per room.

Per the Fair Housing Act:

(k) "Familial status" means one or more individuals (who have not attained the age of 18 years) being domiciled with--


(1) a parent or another person having legal custody of such individual or individuals; or
(2) the designee of such parent or other person having such custody, with the written permission of such parent or other person.


The protections afforded against discrimination on the basis of familial status shall apply to any person who is pregnant or is in the process of securing legal custody of any individual who has not attained the age of 18 years.

Your landlord sounds completely legitimate.
If he does not know that you are pregnant and has already told you that he is raising the rent without mentioning your pregnancy, then he has done nothing wrong.

Whenever a lease comes to renewal, the landlord has the right to decide whether to renew your lease and they have full right to raise the lease, as long as they are acting accordingly with other tenants. I can imagine this is very common, considering the current economic climate. I just renewed my own lease and it went up slightly.

I would suggest simply accepting the raised lease price if you like the place that you are staying and keep your good relationship with your landlord.

i dont think that you have anything to worry about, especially if he is happy with you as tenants. legally, he cannot descriminate because of your pregnancy, but you don't have any proof that he plans to. he has informed you fairly that rent will go up. if you want to be on the safe side, don't mention the pregnancy until after you sign. however, i don't think that it will matter.

It is normal to increase rent annually; and I don't think anyone in their right mind would assume that because you are having a baby that you have tons of extra cash to throw around. If anything, it would be the opposite b/c a lot of times money is tight when a couple has a new baby. Don't stress yourself out over this silliness!

LL can raise your rent as your lease expires. LL has right to limit number of people in apartment, and has to comply with local zoning ordinances. As long as the baby is also female, or if male, is under age 5 or 6, you can have two children in a BR. LL can raise rent for extra person in apartment, too.

Refusing to rent to families can be illegal discrimination, but that's not an issue here.

If there are similar units under that landlord's management that are not going up, then you are almost certainly being discriminated against.

It is absolutely unlawful for a landlord to charge excess rent for couples with children.

However, if he's raising rents across the board, it's probably for legitimate reasons. Utilities like water are going up, for sure, and property taxes in a lot of areas are on the rise, as well.

I think your being a little paranoid - it doesn't sound like he wants to lose you as tenants or that he has any reason to.

It sounds like he had a legitimate reason to raise the rent.

The only way it can be considered discrimination is if you were to be denied a rental that DOES have enough space for your family. Landlords have every right to deny rentals to families if it is not big enough.

He could legally not renew your lease if the additional child exceeds the # of people allowed in the unit. It doesn't matter if you think it will be cramped or not - it only depends on the # of people allowed. For example: some people would be comfortable with 6 people in a 2 bed place but that would not be allowed.

He could also legally not renew your lease and not give you a reason at all. He is not required to renew it or give you a reason why not.

I know this may sound a little harsh - but its the law
