Council flat can you advise please?
If a couple, husband in a full time job and wife temping been on the housing list for 4 years now, currently renting but cant afford a living ( rent, food, credit...ect) can they be considered for a council flat!?

thinking of moving to in laws, that will be considered as homeless in the council register, but keeping jobs how this will affect the application!?

any advise is appreciated.

As your couple is already on the council list, I'm assuming they are eligible to be housed (not everyone is). The fact that they're working won't have any negative effect.

If they move to the inlaws, while they might be considered to be homeless, they could also be considered to be intentionally homeless. Before they take such a step, they should get advice.

Anyone applying to a council as homeless has to satisfy 5 tests; these are carried out in sequence. The first is the eligibility test, which I'm assuming isn't a problem.

The next is whether or not they actually are actually homeless; living with in-laws can be classed as homeless, so that, too, should be OK.

The third test is priority need; you don't say if the couple have children or any health problems; without these - if they're fit and healthy - they're unlikely to be considered in priority need.

The fourth test is whether or not they are intentionally homeless and this COULD be a problem; if someone gives up accommodation that they had a legal right to occupy, without a "good" reason they will be considered to be intentionally homeless and the council will stop there - and should allow the couple to remain on the register (waiting list) but will have no immediate duty to rehouse them.

Giving up accommodation because it's too expensive can be a good reason for leaving it, but the council is likely to look at whether or not it was affordable when they moved in. Have they claimed Housing benefit ? Why is it unaffordable - rent should always have priority over things like credit cards and bank loans and if, for example, a family loses accommodation because they paid credit debts ahead of their ent, then the council may consider that, too, to be intentional homelessness.

The fina test is local connection. Your couple can apply to any council in the country but a council can refuse them if they have no "local connection" - but should then refer them to the authority they DO have a connection with.

The best source of advice for housing issues such as this is Shelter, or the local Citizens Advice Bureau. Links for both below. The Shelter link is for England; the same site has advice for all parts of the UK.

Have you thought about contacting your council and applying for Housing Benefit? In my area, they still operate a council house list, but as it is so difficult to get a house, most people will just rent a private place and then top up on Housing Benefit.

This means I'm able to live where I want, so I live in a good catchment area (for when the children come along) and a nice area of my town, and me and my DH don't have to panic so much about making ends meet.

where i live, anyone who doesnt own a property can be on the housing list, but the people are put into bands a-d, a=priority d=non priority, and if its a couple then useually at the bottom of the list if no disabilitys.

and if ur on the lower bands its still a 5-8 year wait for a property

You're need is based on your current housing conditions. If you are sharing a property and are compromised on space and general loving conditions then you attract more points for the waiting list. As a previous person said, however, the fact that you are a working couple does slow things down for you as I'm sure you've already noticed.

I'm in America. I assume "council flat" means either public or partially subsidized housing because you mentioned having applied four years back. Yet, the principles are often the same.

You have to find out the top salary at which you can qualify. Housing authorities are famous for letting everyone apply and telling them that their income disqualifies them, in some cases 1o years after applying. Why? The only income that matters is what you are making the year that they call you. Sorry, Rolf, but if they haven't called you, there is nothing you can do. The homeless thing is meaningless because many people are applying exactly because they are stuck in some relatives' house in a very expensive housing market.

So, check what the top qualifying salary is every year until they call you. They don't care if you are temping either. The difference between a temp and a full time employee is often that the employer was able to afford the second one.

You should first ascertain what council vacancies are for your area.

A move to the in laws may be a good way of getting a house
but depends on what area you will accept a house in.

Stayning with the in laws may not automatically make you homeless.

Try contacting a houseing charity or association in your area.

You may have more luck if you can prove a breakdown of the relationship and get single homeless accommodation first.

But all depends on what area you are in and the demands on houseing stock there.

Because your a working couple with no children or disabilities then you'll not be in high priority. You don't want to start messing aound with considering to be homeless, even the homeless don't get council houses straight away, they will be put into temporary accomodation like a B+B for anywhere up to a year, so be careful what you say to the council. Why not apply for housing allowance, you might not be entitled to all your rent paid but might just be enough to keep you going until you've got a council house!

Having a job doesn't affect your homelessness. If you are homeless you should have priority.
However they take forever, I've been looking for a move on health grounds for a year now... but of course I'm not homeless.
Giving up your (privately rented?) flat may have an effect on your homeless status. It would help if your lease was up and your landlord asked you to leave.

Go and speak to the local housing office first. Tell them your landlord has said the he will be raising your rent and you are worried about being able to afford it. You may be surprised at how quickly you get housed. You only need a 1 bed flat and most councils have more of them than anything else.

You may not get much choice of where you live though. Whatever you do avoid the high rise flats. They tend to be full of misfits

If you move to your inlaws you would only be considered as homeless if that meant your in laws was overcrowded.

If anything the fact that you are both working is a plus point.

You can't actually be refused for council property.However the lists are huge and average wait can now be up to 10 years.Many people will jump ahead of you,ie disabled etc.
Because there are so few council properties available,then even if you did get housed you would find yourself living next door to drug rehabs,suicidal,schizos and anti-social misfits.These are the higher preference people.You rarely get nice quiet folk getting housed anymore.It's not like it used to be at council properties.
You both should study in evenings for qualifications to get higher paid jobs.There are plenty ways of earning a few bob more in life.
The only way if you want to be a sponger is to make yourselves genuinely homeless.Then the council has a legal duty to house you (but it might be in a grotty hotel for a year firstly.
