Counsel house problem. Can i live there after my father dies?
My father is ill and i don't think he will live 6 months, I have decided it is best if i moved in with him. That will mean giving my counsel house up and moving me, my husband and son into my fathers counsel house. We are all happy to do this but has anyone any idea what will happen once my father dies. I will tell the housing office we are moving in as i will be giving my house up but will i get kicked out my fathers house or will we be to carry on living there? please help! i don't want to end up homeless but i want to be to give my father my full help.

The law about this is quite straightforward at the moment, you can inherit a tenancy, it's called succession, if you are a family member who has been living there for at least a year, the same goes for 'assignment'. You do not have to have your name on the rent book, your father just signs a declaration that you have moved in and the council asks for any other proof it needs. I realise that this is not going to help you a lot. I cannot say how lenient the council would be in the 'turnaround' time but I think you should be prepared for the worst and look at your other options, it would be nice to think that the relevant councils would respond with some creativity and compassion in this situation but I really do not think you can bank on it.
I think a question you have to ask yourself is if you actually want to relocate from your present area to your father's permanently. If you do a council will sometimes give you a tenancy in the area if you need to support a family member, but given the current shortage of council housing I wouldn't hold out too much hope, and of course the other option is an exchange. If you don't want to move permanently I would suggest keeping your council house on and seeing if there is some way you could be supported to move either into your father's or somewhere in the area as temporary tenants, if there isn't a means to do this there certainly should be, maybe there are charities that could help, I know you don’t need this at the moment with your father being ill but I really think you have to realistically prepare yourself for quite a fight.
In my experience councils aren’t too good at thinking ‘outside the box’ so you might just get a load of bureaucracy shoved at you if you expect any direct help from them.
I wish it wasn’t like this, as you are obviously doing the right thing in wanting to look after your father. I suggest pulling out all the stops with the health services, social services, carers groups, any specific charities relating to your father’s illness, and seeing if anyone can come up with a sensible solution.

It has just occured to me that if your circumstances permit the easiest option would be just to go and stay with your father and keep your council house on, as far as I know it isn't against your tenancy agreement to stay away from home for a while, a lot of people on our estate have relatives overseas and do it regularly. You can set up a direct debit for the rent and council tax and arrange for the utility companies to bill you at your father's, and if you have a friend who can pop in and keep an eye on the place so much the better.

However what ever the Council says get it authorised at a senior level and in writing.

Your father is currently the tenant but there is no 'inheriting' of the tenancy. You and your father could write to the council stating that as he needs in-house care it is your joint wish that you move in with him to help him and can you be officially made a joint tenant. If your own council house is with the same council and you state that if you can be made a joint tenant you will give up your existing tenancy then they would win wouldnt they, get one house back.

Ask your father to put your name on the missive and make it a joint tenancy, that way you wont be homeless, as long as there is enough bedrooms for everyone i can see the council objecting,

Some councils will also see it as you giving up a house for someone else to move into, when you move in with your father, so there is every chance that they will agree.

i think if ur fathers agrees for joint tenency agreement through the council with u and him on the agreement, if he dies then you will take over the tenency agreement.

Adding ones name to a rent book does improve your chances of maintaining the tenancy but it is not obligatory.

The local housing office will judge each case on individual merit,ie demand,points,time in residence and personal circumstances.

In essence,you have no right to keep the tenancy.If you were to approach the housing office in advance then I am certain that they would remind you that they can consider your temporary tenancy as an opportunity to jump the queue.

However,it certainly is worth tentatively checking your rights before committing to a permanent move.

Really depends on the Council, but you should make them aware wwhat you are proposing to do and why.

maybe a good idea to seek advice from other organisations in the area that would have an insight into how that particular council go about these thngs.

Your name will have to be put on your fathers lease for you to get his house if he dies. I would check with either the council or the CAB to double check as you say you dont want to end up homeless by mistake!
