I went to my cottage that I own and I walked up to the door noticing the screen door jammed open and the main door had no doorknob on it, it was lying on the floor. I noticed a note on the door that said "Home winterized by Country wide" then a bunch of numbers and letters. I called the police and it was reported as breaking and entering. My cottage remained without a door lock for over a week because I had to return home and go to work.
I've spent hundreds on gas going back and forth. The first 20 times I called Countrywide they asked me for my loan number, I DON'T HAVE A LOAN WITH THEM! They said they couldn't help me. They broke into my house!!!! Finally I get a callback after faxing them the police report and a letter saying I was getting a lawyer. They asked me what I wanted them to do. I said I wanted to be reinbursed for the gas money, repairs on the doors, and repaid for all the time and aggravation. Well they said their Home Preservation Dept would contact me, 2 weeks later, NOTHING! These manipulating criminals need to own up for what they did. They thought my cottage was one they forclosed on down the street.
This is COMPLETELY unprofessional and I feel like calling the CEO and taking them to court for $50,000. You don't break into someone's home, intentional or not and then pretend like you never did it and not have the decency to call me back. They are inhumane and have NO integrity. Now I'm getting a lawyer, what should I ask be done?

I am not certain where you or your cottage are, but this is happening a lot due to the high number of foreclosures on the market and many municipalities passing codes forcing the mortgage holders to maintain and repair foreclosed properties. You are entitled to your direct expenses related to the incident and damages. You probably have a bigger case than a small claims, so you were correct in hiring an attorney and should include his/her fees in your damages. |

You are doing the right thing to get a lawyer because if they broke into the house mistakenly then they owe you for the damages. Keep your paperwork and also take pictures of the house down the street. I'd even grab the sign on the door of the other house to prove it was the same company. If your house doesn't even belong to CountryWide then you have a case. Unfortunately the lawyers fees will probably cost you more than the gas and repairs. But I'd request your lawyer fees to be reimbursed too. |

As someone else stated, you'll need a lot more proof than just one piece of paper you found on the floor to prove that countrywide representatives were the ones who broke into your house.
If you decide to proceed with a lawsuit, ask for compensation for all of your expenses, plus a reasonable amount for your time, plus enough to cover your attorney's fees so that you actually get enough money to cover your time and expenses.
There is a good chance that countrywide will just offer you a settlement if they think you have enough proof to win your case. If they offer to settle out of court you need to subtract your attorney's fees from the settlement amount and decide if that is enough to compensate you for your time and the cost of repairs. |

Contact an attorney. In some instances all that is necessary is a letter from an attorney threatening legal action. They will then settle out of court. There might be a fee for the attorney writing the letter but it will be a nominal fee.
If they refuse to settle out of court tell you attorney that he has to get his fees from the eventual settlement, therefore it will not cost you any up front cash.
Make sure you have the right culprit, because if you don't they can turn around and sue you for attorney fees and lost money defending themselves.

I haven't had this type of experience with Countrywide, but I have with another REO lender.
At least twice that I remember, we were given the wrong address of a foreclosed property. Both times, the properties were occupied and you can imagine the agony caused to the occupants when they were told the house had been foreclosed and they had to move or get evicted.
Both times the problem was identified and resolved quickly.
You definitely should get a lawyer immediately. You can't really handle this by yourself.
Here's what may have happened. As you noted, Countrywide foreclosed on a house in your neighborhood. Somehow, the street address was written incorrectly - this is where I see the main problem coming into play.
It sounds like your house was vacant, is that correct? If not, were your personal items removed from the house? You didn't mention this, so I guess that means the house was vacant.
Usually the bank has a local company that provides services to them for the foreclosed properties. Sometimes it is a real estate company/agent. Other times the bank has a property maintenance company (that may be a local sub-contractor to CW home preservation dept) that will do the initial re-key and "trash out" of a foreclosed property.
Somehow your address made it on the paperwork as the house that was to be taken over. Since your house was vacant, the error went undiscovered until you went to check on your property.
Maybe the real estate company or the property maintenance company made the mistake. Maybe Countrywide's legal team put the wrong address on the paperwork. Maybe Countrywide Loss Mitigation department put the wrong address on foreclosure paperwork. But, someone made a BIG mistake.
Get your legal eagle on the case. I would imagine it should be resolved fairly quickly. You can't really handle this by yourself.
Luckily you didn't live in the house. Can you imagine coming home to find your house emptied and the locks changed?

Someone may be framing the company to steal your identity or things from your cottage. However if it was the company, this was completely unprofessional and you should seek compensation for everything you've gone through (itemize the list to get maximum compensation). |
