If your name is on the mortgage...
DO NOT TAKE YOUR NAME OFF THE HOUSE.
Else, you still owe the mortgage but have no rights to the property. Not good.
You need an attorney and the correct document is a Quit Claim Deed.

To summarize the advice above:
It's easy enough to remove your name from the deed. In most jurisdictions, a quit claim deed will do it. Although that could be done privately, then recorded (for a very small recording fee--maybe $5-$15), it'd best if a lawyer did it. It still won't cost much, maybe $100 or less.
However, if your name is on the mortgage (the IOU to the bank), you'd still be on the mortgage even though you wouldn't have any ownership interest in the property. And that's something you usually want to avoid. (If you owe a debt, you might as well have some ownership in whatever the debt's for.)
I suspect there's a lot more going on behind the scenes. Best advice would be to consult a lawyer to make sure that whatever you want done is done properly, protecting your interest.

Depends on what state you're in. Most states, all you need is a Quit-claim Deed recorded,notarized and filed with the county clerk of records office in the county where the property is located.
You should check with a lawyer before filing to make sure about any other law in relation to your property. |

if you signed the note the only way is for him to refinance it in his name alone and you to quit claim it just before closing. If you are not a comaker on this note then simple quit claim can be executed and filed for a few buck but get a title agent to do it so it is done correctly then the cost is about $150 |

If there is a mortgage and you quit claim your interest to anyone, this could trigger the due on sale clause contained in most mortgages. Read your mortgage.

It does cost around $150 for the Quit Claim Deed to be filed to remove your name from the deed. Just remember that if you are on the note you will still be responsible for that note. If he refinances on his own you will be free. |
