No. It would have to affect the general living parts of the apartment: living room, bedroom, etc. |

No. A bathroom heater is a convenience, not a necessity. There are many, many places that were built with heaters, but as time passed, broken ones were never repaired or replaced because they were regarded as fire hazards (usually the radiant heaters). Some states only allow rent withholding for things that affect habitability, like water, plumbing, power, and heat for the entire unit. |

No, they cannot. They have to understand that Maintenance and Rent are two different things. You can evict them for not paying rent but they can also put you in trouble if you don't fix it in 14 day. |

It would depend on the jurisdiction where you live, and what the lease agreement specifically says, but in general the answer is "no".
I think that you are probably thinking of a legal doctrine known as "constructive eviction" where the apartment becomes so run down as to be unfit for human habitation [which is seen as a breach of contract by the landlord], but this requires for something major to be wrong. A bathroom heater is probably going to be seen by a judge as a minor thing. Most homes don't even have a bathroom heater, so it obviously isn't a necessity. |

very doubt full but you are able to make them fix it and if they don't then you are allowed to pursue legal action...just call a local lawyer...laws are different in different states and counties...also does it effect the heat of the whole appt or just the bathroom is one thing to consider... |

Probably not, it could not possibly affect the temperature of the entire apartment. Send them written notice and give them reasonable amount of time to repair it. If you document a pattern that they are not responding and not making repairs, then you could take stronger measures. |

No - really only if the landlord refuses to fix things such as the heat in the entire home can you consider refusing to hold up your end of the contractual arrangement. |

it depends what state you live in, he can still evict you, for non payment. I say pay the rent. Sent your landlord a notorized letter of the problem and the state when is a reasonable time to have it fixed. If you have no response then you should notify the building inspector for your town or county. the health department may work too. If the landlord takes too long I think that you can pay to have it fixed and deduct that from the rent. keep your receipts and incase he sues tell the judge it was a verbal agreement to pay to have it fixed and take it out the rent.
You can try Prarie State Legal Services if your in Illinois, but call your court house and ask if there is any state programs that would allow you to take to a lawyer for free, and they will better understand your state laws |

I guess it depends on where you live. I know that if something like that happened around here, the rent would probably be decreased for the time the heater isn't working. Whoever owns the apartment would, of course, have to pay to repair it unless the problem was caused BY the tenant. It's all about what's in the contract/lease. |
