Did the landlord just trick my mom? ?
Have you ever heard of a 1 Year lease lasting only 6 months?

Well this is the story .. the landlord renewed the lease 11-21-08 .. he had pre-dated it for 07-01-08 and she signed it .. i know ... her fault ... My mom is not good when it comes to signing things and i think he knows that and tricked her. So know she has a 1 year lease that will last her six months because he tricked her.

Is this legal? .. can anything be dont about it to refute that in the future? .. can he be taken to court ??

any possible information about the action that I can take to help my mother. Thanks

I would look into contacting a lawyer. Did she date it anywhere? Does she have a previous contract??

a contract is a contract see a lawyer for legal advise. She should have retained a copy

It is illegal. It's called fraud. Since the lease she signed was for renewal, then there is a previous lease which she signed which will show the date it would have terminated. So no new lease could be signed before that date, and certainly not six months before, since the old lease would have been good until then. So she has that as an indication that she couldn't or wouldn't have signed it on 07-01-08, but rather on 11-21-08.

Look on the net for your governments' minister of housing.

Look for the Tenant Landlord Act--call them & ask THEM.

Many times in many places, landlord leases aren't dealt with in court but through administrative tribunals.

so you need to find out what it is for your area.

I would talk to a lawyer---this doesn't sound legal, but maybe there is some other kind of complication. Maybe teh building got condemned or is changing hands.

Yes, it seems that he tricked her. Ask him to give you a copy of it and then when you have the copy in hand, confront him and ask him about the backdated contract?

does she have a copy of her old lease showing the end date? Did she date her signature?

your mom really should have looked at the dates and everything before signing. since it is a signed contract i doubt you can do anything, call a lawyer though. you did say it was a renewal so maybe theres a way to prove the landlord wasn't being entirely honest since most people won't renew their leases months before it ends. like i said though, call a lawyer. they always have the most expensive advice.
