Disclose or not to disclose....that IS my question!?
I had a condo built in a brand new complex about 3 years ago. From day 1 I began to have plumbing problems at the frequency of once every 3 to 4 months on average. Last year, after much documented evidence and pleading with the builder, they discovered that I had a condition known as backwash where instead of the water in the toilet flowing away from the condo into the main sewer line it would on occasion (if all conditions were right, like everyone in my building using water at the same time) would come back up into my condo. It was caused by a sinking of the main line right at the point of the plumbing entering my condo. In any case, last July the builder agreed to replumb that bathroom and the associated plumbing. I have not had a problem since that time and feel that the problem has been resolved. In light of not having problems, is it necessary for me to disclose that I once had this problem to potential buyers. I am afraid if I say something it will deter a potential buyer. HELP!!!! I agree with those who said to you to disclose past problems with your condo and with common areas. Be specific as to the problem. But more importantly, be specific as to the corrective action taken. Make the effort to get the name of the contractor who made the repairs and the date. Explain the bcorrective action taken. Disclose if the problem was corrected to the best of your knowledge. You are not expected to be an expert with sewer systems, but do try to explain the situation as best you can. You want to come across as sincere, truthful, and open.

Now, this is VERY important: If anything goes wrong in the future (could be years) with the sewer system of your condo, the present owners may come after those responsible for their predicament. Since you disclosed fully, they might not blame you. But if you indicated the builder and the repair contractor, the owners might go after them with zeal. So, my advice is DISCLOSE, DISCLOSE, and DISCLOSE.

No, since it is fixed you do not have to disclose it. But, if you are asked about prior problems, you must tell the truth. The listing agent would then need you to show papers or anything you have to verify the problem was corrected. So no, do not disclose unless you are specifically asked. When you sell you will have to fill out a seller's disclosure and it will just ask questions and you put the last date of service on there, which would be when it was corrected.
But- think how you would feel, would you want to know anyway?

No, I wouldn't. If it's not a problem now, it shouldn't make a difference; it's fixed. No point in bringing in something that isn't a negative, that'll make it a negative.

Yes, and I would also keep copies of the repair records from the builder for future reference. If you had to file an insurance claim for water damages it may already be on file and will come to light when the new owner tries to insure the condo.
Disclosure laws are different in each state so check yours.
I say,Honesty is the best policy and what goes around always comes around.

You absolutely must disclose, and then indicate how the problem has been subsequently resolved.

If someone finds out, and they will if they talk to the builder, about the problems you didn't disclose, you will be facing litigation. And you'll lose.

Just disclose the problem, that the problem has been resolved, and you are doing the right thing.

Yes, you might scare some buyers off. And if it's been fixed, that's great.

Still, you really need to let people know about both the problem AND the repair. If there are suddenly problems that start up after the purchase, they new owners may come back on you for not disclosing. Plus, if there were to be problems in the future, the new sellers really sould be privy to the documentation you've got on hand.

Since improper handling of raw sewage is a health hazard, you can't be too careful with this situation.

You have to disclose the entire history of the condo, including repairs and such.

This is a federal statute, and if a problem is discovered later - and you had not disclosed - you could be held liable and sued.

you should disclose it if you have to complete a seller disclosure form but you also should indicate and document it was fixed, if your state doesn't have seller disclosure law, don't bother
