John Elias | Dispute with Landlord - over letting potential buyers view the house? |
In January, our Landlord informed us that he was planning to sell the house this August. We declined the offer of buying it ourselves and have now bought somewher else.
The dispute comes with letting people view the house. The estate agents are being a real pain in the ***, and are arranging viewings with little notice, and even a couple of times without our consent. Now the Landlord is insisting on his having a key so he can let viewers see the house himself when we are out.
I've been told by someone that we don't have to let anyone view the house while we're still paying rent, though in the contract we signed it does say that we do permit the Landlord to show prospective buyers round (like we read it all or realise the relevance of it all at the time!).
Is this lawful? Do we have to comply with our unreasaonable Landlord's demands, or can we refuse to allow anyone to view the house til we leave?
Thanks. Additional Details We've already shown a number of people round ourselves, and have had last minute cancellations numerous times which are very inconveniant. It's the Estate Agents that caused the initial problems by not listening to us, and not rearranging viewings to suit us. We're two very busy people and have already postponed our plans only for the viewings to be cancelled last minute.
The Landlord is now using bullying tactics, and forcing us to show people round, or for them to do the showing when we have already made clear those times aren't suitable to us. We're the ones being messed about here, and the only ones who have gone out of their way to help the others. |

if the House is listed with a real estate company you don't need to be there at all and for sure should not be showing the house. it's not your house to show and that is what the agent is paid for
yes you are to allow all showings, when someone calls you can be reasonable and ask for one hours notice so you and family can leave walk down the street go out to dinner or sit in back yard, but do not be inside of house and you should not answer any questions if someone does you should tell them there agent needs to call sellers agent .
depending on what your lease says most leases say you can with draw from any showings with a months rent paid and then of course you would move out.
and that bring this up . why don't you just go ahead and give the seller notice and move then they can show a vacant house. |

Most (but not all) states have a required notice before entry. You must get that notice (24 hours in most states). If not, they are breaking the law and you can refuse to show the home. Otherwise, it's his home, and you even agreed in your lease to show it.
It is unlawful to refuse to allow your landlord to have a key. He should have one anyway, without your help, but that's beside the point. You can also be evicted for not complying with your lease.
You need to speak with your landlord and his realtor and demand the appropriate notice. Other than that, be courtious during the showings and save yourself later hassle with security deposits and such.
Edit: Your landlord is not responsible for ANYTHING missing out of your house at ANY time. If you have valuables, put them somewhere safe or get renters insurance. |

The important bit is where you signed to say you permitted the Landlord to show prospective buyers around...so you agreed to that like it or not....I think it would be reasonable to say that viewers should only visit between specified times, say 6pm to 9pm on weekdays and say 1pm and 5pm on weekends. I used to show people around houses for an estate agency and used to give plenty of notice...although I did once catch someone in bed....the estate agent will be reasonable if you are, but I'm afraid you will have to agree to what you signed up for. Always read the small print. |

My thoughts are they do have the right, they have given notice in January. My concern would be the showing of people without notice etc. Contact Citizens Advice or a solicitor for more info |

Legally the landlord must give you 24 hours notice before he can let himself in(UK), although I'm not sure what your having signed the 'allowing viewings' clause will have done to your legal rights (ie you may have signed them away) Its hard to tell without seeing the contract.
Take it to your local citizens advice if it's really causing that many problems. |

I would recommend being a little less resistant and allow them to show the house. Just be firm with those Realtors when they call, and if it's inconvenient, schedule another time.
Why be selfish about this, and offended that you have to help someone?
This reminds me of not allowing someone into your lane when they have their blinker on, because you feel that YOU have the right of way.

It doesn't matter that you agreed to allow him to show people around- he still can only do this by giving you proper notice and calling at a suitable hour. He is not entitled to enter your home even if he has made an appointment believe it or not- the law is heavily weighted in your favour. Of course it is better if you can solve this amicably but i suggest you look at www.shelter.org- it has very good advice on there as does www.thesite.org- good luck. |

signed to agree to the terms in ur lease. so yes, he may show the proerty with little or no notice being that you agreed in the lease to allow him to . he may only show it during regular 9-5 business hours. anytime after u may not allow the viewing. the guy must sell his property and although it is inconvient for you, u still signed and gave consent. u cannot go back on it now. |

Look, yes your in the right legally, etc but this whole thing is a waste if time arguing about, he's going to sell the house so your going to have to go in a month or so anyway so hand your notice and move out.
Fighting will just stress you out and what are you goin to gain from it? An extra 2 days staying there?
It's a waste of time, the guys an idiot so pack your bags and see him lose out on your rent because he can't go putting someone in for only a month now, can he? |

This is how I would handle the situation:
Tell your landlord and his Realtor, that you expect a 24-hour notice...PERIOD, otherwise, I would tell him not to expect the house in viewing condition....and if I were you, I wouldn't knock myself out to do it. If a Realtor calls, just tell them no.
The landlord is doing HIMSELF a disservice in selling the home and first impressions are everything.
I would also remind him that if anything is missing while he allows people into the house, then he is fully responsible. That is part of what a Realtor also does...is watch people while they are in a home.
PS: I would go to the dollar store and buy a bunch of cans of Raid, Cockroach spray, etc...and start leaving them in open view of the house, especially in the kitchen...I have a feeling that it will be the last time he comes in with someone without calling you first. Yeah, it's mean...but it will get the message across. |
