Hello, I am a single mother of 3. I have been in my apartment since 2/28/08 and since then have made several calls to maintenance to come and patch up mouse holes in my apartment. They come out and say they dont see any holes but later that same day I have to call them to remove a mouse from a glue trap located in my apartment. I have even showed them where the holes are located but they still havent done anything. I am basically living in 1 room of my apartment, which is my bedroom. I cant have company over because the mice have taken over my apartment. The final straw came last night. I had given my babies a bath and locked my bedroom door. We all sleep in my bedroom so I can keep an eye on them due to the mouse problem. Someone broke into my apartment and was attempting to push my bedroom door in. I called the police and literally had to climb out of my bedroom window with my 2 little ones in my arms. I went and sat in my car until the police came but by the time they got there, the intruder had left. They werent very thorough, after they left, I noticed my living room window was unlocked. I am very upset, my world has been turned upside down. I visited the management companys website and it clearly states that any maintenance request not handled within 24 hours, they would credit the tenant 1 day of rent until it is resolved. Am I not entitled to a new apartment and to get my account credited. I have had to live among mice, and their feces...Please help me? Additional Details First off ...

I have fixed the holes myself and spoken to neighbors and they too have a rodent problem.
The rodents have chewed through the "fluffy stuff" and have also chewed through the steel wool that has been placed there.
My apartment is clean, no dishes left out, nothing...I work full time and also attend school.
Maintenance has come out and claim they see no holes, I have put the glue traps down myself...and h*ll no I am not gonna do the job that my landlord should be doing.
Yeah everyone can have a break in but my concern is for my childrens safety, not so much my own...whomever was in my house, knew we were in the bedroom and obviously intended to cause us bodily harm... |

call your local health department! see if they have any sort of regulations about rentals. depending on what state youre in, you absolutely have rights as a tenant. hopefully a health inspector can come out and do an inspection, you can show them all of the holes and mice and droppings, they will write up an inspection report and send a letter to the owner to have them correct the violations within a certain number of days. if not, they will face penalties for non-compliance. this is how we deal with rental issues on cape cod.. not sure how different regs will be in your area, but worth looking into. to me, you are absolutely entitled to getting credited for the hassle.. complain to the management company, and call the health department, you have rights! |

Call your local health department. They will likely help with the mouse problem. In the meantime. Take steel wool that you can buy at your local dollar store and fill the holes. Send your landlord a certified letter with return receipt stating the problems in the home and your request to have them rectified. Many leases state that your maintenance request must be in writing.....if you are just calling then it is your word against theirs about receiving the request. |

If you are a mother of 3 then when you crawled out the window you seem to have forgotten one child so I'm skeptical about your story.
First of all your LL is responsible for extermination within your apartment have you addressed the rodent issue or have you only addressed the mouse holes? If you cover a hole the mice are only going to find another way in thru your AC vents and ducts or chew another hole so you're wasting your time with covering the holes. The LL needs to bring in a professional exterminator to eradicate the mouse issue, if you have mice so do all your neighbors, have you spoken to them have you found out if they too are living with rodents?
Have you addressed this mouse issue in writing and kept copies for yourself? If after 2 weeks the onsite maintenance has failed to eradicate or send someone to lay traps then your next step is to contact the health department and have them come and inspect your apartment and the living conditions. If they feel that your place has become uninhabitable and you have a rodent infestation then they will fine the Management company and make them comply with removing the mice.
If you haven't addressed all and every maintenance concern in writing how will you prove that you did all you could in a court of law if that's what it comes down to? In this life you must cover your *** on everything, send letters and keep copies, make calls write down who you spoke to the time and date and the conversation. Even photograph the dead mice and their droppings.
If there is a mouse problem in your apartment then the entire complex is overrun with mice so moving will not solve your problems. Calling the building department and asking to speak to a housing inspector and calling the health department is where you should be going after you've notified your LL and the management company (the company that oversees the building not the onsite manager but their boss) in writing of your problem and their need to address the rodent issue not the holes in your wall.
Also go down to your local hardware store and pick up Decon Mouse Killer and put it around your apt under the sink around their holes etc, they will eat and die. Pick up the mouse yourself and throw it in the trash, maintenance isn't there to pick up your dead mice. Also if you are contributing to the problem in any way, garbage piling up, food everywhere etc then the mouse infestation will become an expense the landlord will make you pay for same as a roach infestation. If your place is clean mice will go elsewhere looking for food.

Dear, it's time you take matters into your own hands and quit whining like a child. Mice are NOT going to kill you and/or your kids. I have never heard of an 'attack mouse'. Get some mousetraps, mouse poison, and remove anything which the mice see as a free meal. The notion that you keep all three kids in your bedroom because of some mice is almost laughable.
For your information, I live in a rather new $400,000 house and (guess what) we also have some mice. Take care of getting rid of them. |

No, you aren't entitled to a new apartment. You are entitled to the one days credit on your rent just like it states. I find it hard to believe they can't see a hole where mice have chewed their way in or that the landlord wouldn't want to do something about that pronto. I'm sorry your home was invaded but homes in this country get broke into everyday. If you owned a home you wouldn't sell for either of these reasons and neither will get you out of a lease. |

you have traps ..so i assume you kept receipts and i assume you have photos as well.
you need those..receipts for the traps..and photos with the dates.
now..........the local health board..and a housing authority..review board..
shame you have all the time to ask on here and you can't ask the neighbors... well ask them cause the best voice is a voice of "the entire building"...rather than being held hostage...ask those neighbors...a "voice of many " where the building is complaining is much stronger than yours alone. Also i am surprised that one of the neighbors has not asked you to join a "force" if this was a building problem.
Now if this is only your place. you have 2 things..keep all your receipts and phone the department of health on how to get rid of the "critters"...(you have let this situation make you a hostage rather than actually doing something)....
Really surprising someone from the building hasn't asked you to join a force if this was a building problem...If it is sole to your flat.. then get your documents and you can file a claim for a refund in "small claims" if the building / supervisor/ owner/ is not dealing with the problem.

The break in is not a reason to break your lease. The landlord is not liable unless the door locks were faulty. Crime happens everywhere.
As far as the mice, you need to call the local housing inspector in. If they find the landlord is not taking proper actions to exterminate the mice, they will force him to do so.

Ok, you are being ridiculous...do you call them to change the light bulbs too and to flush the toilets?
Mice don't stay where there isn't food left around and I think before I would subject my children to mice, instead of waiting on maintenance I would spend $2.50 on a can of "fluffy stuff" that you can buy at any home improvement store to seal the holes.
I also wouldn't live with a dead mouse in the house but be AN ADULT AND A MOTHER and throw it in the trash. Your arms aren't broke.
That will take care of your mice problem.
Also, if someone is breaking into your house, then you should have done research on the crime area of where you lived.
As a landlord, I have NEVER had a tenant that had a mice problem that wasn't leaving out dirty dishes, dog food, cat food, bird seed...letting garbage pile up, etc.
Never...and I have had rental property for a very long time.
