Do I have a deadbeat tenant or am I just overreacting?
I've been renting my second home to a tenant for about 1.5 years now. This is my first time ever being a landlord. At first, he paid on time; after the first 6 months he would start sending the check 3 or 4 days late. Now his on time payments have become sporadic. Sometimes he sends on time, other times hes a week late. I usually have to call and remind him to pay me. the worst was 5 months ago, when it took him 3 weeks to send me the rent. Am i overreacting or is this normal? Other than his late payments, I dont have any complaints. I understand the economy is bad, but I am affected by it too and i need my rent on time!

He was'nt 5 months late, I was saying that he was 3 weeks late about 5 months ago. Also, the lease agreement states that after 7 business days of being late, he gets a notice; thats the first step in eviction. I had to send that letter to him once so far. Hopefully it was the last time too.

I found www.NoPayTenants.com is for reporting deadbeat renters. All rental property owners need to checkout that website and post their deadbeat renters. When renters find out their name is on that database they quickly want to pay-up. Also, it helps other landlords from getting burned and you can check if any renter has a record.

Start posting Pay or Quit notices on the door after 1 day late. This sometimes gets tenants to take notice.

Have you talked with him or her and asked why. Some tenants will be honest with you. Are you actively charging a late fee? This sometimes motivates too!

Do you have a late fee in the lease if they pay after the 5th? If so, is he paying it when he is late? If so, you are probably better off by getting the late fee if he is only a little late occasionally. If he becomes chronic, ask him about it and explain why it is important that you have that money on time (to pay the mortgage). Give him a chance to explain. If it sounds reasonable, go from there.

If no late fee is required, you may have a problem because he has no practical motivation to be on time. Try to establish one going forward.

I don't know about calling it "normal," but it is pretty common. However, you are not overreacting. The tenant has an contractual obligation. Then on the other hand, sometimes it is better the devil you know than the devil you don't. I would talk to them about it and see if there is a reason and if not do they not understand there's a due date for a reason.

So what if the economy is bad. You are not a charity. He has no excuse not to pay on time.


But, in his defense, you sound like you let things get this bad, you should have pitched a fit the first time he took out a short term loan from you.

Generally a lease has a clause to evict if payments are consistently late. Does your lease have such a clause? It's really up to you if you want to put up with it or try to evict them. However, by accepting late payments you have created a precedent that shows that you will continue to accept late payments, so you may not be able to evict on those grounds alone.

THIS is NOT normal and you have fallen into a trap by not giving tenant ANY consequences. Rent is DUE on 1rst and late on 5th or later--READ the lease you signed. Number one rule for LLs is BE FAIR, but it doesn't pay to be Nice!
Send Tenant a letter, noting that you are glad to have them as a tenant, but that there have been some problems with late payments. State that you have mortgage, taxes and bills to pay on property. Indicate, that per the lease, from this point forward, you will be charging him $25 (whatever lease states) for any payments received after 4th of the month. And Daily late fees for payments after 10th.
Do you have written lease? If NOT, get one at stationery store, READ it carefully, and fill in/put in clauses about late payments, NSF checks, etc. Have tenant and yourself sign it. Without a lease, they're on a month to month tenancy and either you or they can end lease with 30 days advance notice (of date rent due). Lease executed today for existing tenant could not start before March 1.

It is not that abnormal for tenants to be late. Have a talk with him. Since this started 6 mo after moving in, maybe his job changed the date he gets paid. If it is agreeable to your finances, then maybe you could change the date his rent is due to accommodate that.

If he is just being lazy, then send him notices as needed and he should get the point. You can send as many notices as you need to before filing an eviction with the court.

It all comes down to communication.

Is this a yearly contract or a month to month rental? I am sure if he is month to month, you can give him a 30 day notice and tell him if he is late again, he will owe you rent plus late fees. You can ask him to leave and find another place. If it is a yearly lease, you can also give him notice and charge a late fee, but it will take more time in asking him to leave. Check with the laws in your city/state. Good Luck.

well, everyone has their own bad times... but 5 months late is a bit too much, maybe you should limit the time of paying money late
