Do I have a legal right to ask my landlord for money?
My refrigerator broke 2 weeks ago, the freezer still worked, but the fridge was only slightly chilled ever since. It was not cold enough to keep really any perishable products in.

After 2 weeks of waiting and finally determining from the repair man (who came once in those 2 weeks) that I needed a new refrigerator...I am finally getting one this Monday.

However, much of my food has gone bad, enough to the point that I need to go grocery shopping again to re-stock it. So what I'm wondering is if I have any right to ask my landlord, or withhold some rent money towards new groceries.

I'm from PA if that makes any difference.

To answer some questions below:

I told him about it over 2 weeks ago....he did not respons fast at all about it.

I did not re-stock the fridge, but it was full when it broke down initially, and a cooler with ice would not have held much.

The fridge came with the place, and it is not mine.

You have the freedom of speech don't you? You can ask, but that doesn't mean he has the legal obligation to comply.

under no circumstances can you withhold money...im sure you signed a lease and in that agreement will not allow you to withhold.... crap happens just eat the cost....the world isnt perfect refridgerators break.........

Being in PA doesn't matter. What matters is who owns the refrigerator. If you own it it's your problem. If the landlord owns it, when did you tell him about it being broken? He might be libel but he can argue and ask if you knew it was broken why did you keep it stocked. If you withhold rent he has every right to sue you or even evict you.

If you notified your landlord that your fridge was not working and he did not send someone to fix it in a timely manner,and you had to find a repair man on your own, you can deduct the cost of the repair man from the rent, just make sure you have a receipt from the repair man to show that you paid him. If the fridge remained broken and you notified your landlord and again, he did not act to buy you a new fridge, then you need to notify him in writing that you are purchasing a new fridge and will be deducting the price from your rent. If he still does not act to buy you a new fridge in a timely manner, then you have the right to purchase a new fridge and deduct the cost from your rent and again, remember to have the receipt to show your landlord. Most likely, you cannot throw out the existing refridgerator. Your landlord will have to dispose of it.. If you deduct the cost of the fridge from your rent, you cannot take it with you when you leave. It will belong to the landlord. Most likely, you will not be able to deduct the cost of the food in the fridge, because you knew the fridge was broken and therefore the food inside of it would go bad. It would be up to you, knowing the food was going bad, to find a neighbor or friend to keep your food. Unless you kept the food that had gone bad and the receipt of the cost of the food, which I seriously doubt anyone would do. If your landlord doesn't agree, go to small claims court but just make sure you have everything in writing and receipts for everything with dates. In most states , if your landlord is negligent in taking care of rental property after being notified of a problem, and you have notified him that you are taking care of the problem yourself, you have the right to deduct the cost of repairs that you made on your own as long as you have receipts for all work done. I hope that I made sense.

You can't withhold money. You can ask the landlord for some help in replacing the groceries, but you are unlikely to get help. Since the freezer continued to work, your frozen stuff should not be bad. You could have kept most of the rest from going bad by simply buying a cooler ($4 or $5) and adding ice. You should also have refrained from buying more refrigerated stuff and concentrated on using up what you had. This is the sensible way to do things.

It's time you replaced the mayo and tartar sauce anyway and no one keeps milk for more than two weeks.

I'm not sure if there are any legal obligations that the landlord has to you... but it certainly wouldn't hurt to ask! I would just be nice, but firm about it. Also, before you call, take another look at the rental agreement... does it mention anything about this time of situation?

unfortunately i don't think so, but you could ask him if he would be so kind as to help you out a bit.
i don't think a law suit would apply because it's probably not considered a significant amount to make it a feasible case.
