Do I have any right to withhold my rent due to a mouse/cockroach infestation?
My tenancy agreement makes no mention of pest control and when I was being shown around the flat by the estate agent we specifically asked if it had any pest problems to which he answered no. Since moving in I've trapped 3 mice and seen several cockroaches. Would I be able to withhold rent until I was satisfied that they had got rid of the infestation? Or would I be able to hire a pest controller at my expenses and deduct it from the rent if I'm not satisfied with the service I'm getting from theirs?

I have already informed the property management company and they have sent a pest controller around however I am less than satisfied with the baits and posions they are using as I know them to be fairly ineffective as I used to pest control myuself a few years back.

I don't believe you would have that legal right unless your landlord/Estate Agent refuses to do anything about it - however, the infestation could be coming from somewhere else rather than your own apartment. Have you asked any of the neighbours if they're having similar problems?

You must contact the Estate Agent so they can put any problems right.

EDIT

It wouldn't matter how often you treat your home if that is not the source of the infestation.....they will simply return. You need to question your other neighbours as well as environmental health if you're really concerned. Perhaps there is a cafe/restaurant close by - this could be where they are coming from?

Though your letting agent has responsibilities so do you as a tenant and you need to work with them as much as you can.

I wouldnt hold the rent straight away anyway, ask the landlord to do something about it & keep onto him until he does it. If, after a month or so, id tell him you werent goin to pay rent until the place was sorted out but you would give it to him then. We did that with our landlord (it was a leaking shower) and he eventually got it fixed when there was no money coming into his acc!!

No, you cannot legally withhold your rent. AND you cannot get your own pest controller then deduct it from the rent, just because you are unhappy with theirs. All that may do is work against you. And also because the management IS taking care of the problem. But it doesnt happen overnite.
Cockroaches are very hard to get rid of. It can take months and also depends on the tenants. If even one tenant leaves food out, that is where the roaches and mice are going to go for the food source. Then they will take it to their nests, which could be in your apt. They will feed their young and lay more eggs.
ALL the flats need to be done by pest control at one time. And it will take months. Roaches lay thousands of eggs at one time. They hatch at different times. So the stuff the pest controller is using (spray, gel) has to kill the newly hatched ones too. As I said, this can take months.
As for mice, you may not see them or hear them, but every house has them. Especially in the winter.

un less it is in a contract that you can hire your own pest controler. I'm afraid you will have to pay the rent.

Yes you do have the right to withhold rent your landlord is not upholding his side of the tenency agreement, what you need to do is to contact your local enviromental health office, if the landlord won't fix the problem then the envromental health office will help you find a new place to live and the property will be declared as unfit to live in until the landlord puts things right, so he won't be able to rent it to anyone else either.

When you say rent i take it that its rented accomodation. if so I would get in contact with the letting company you use. They would advise you but you probably wouldnt be able to.

You do not have the right to withhold any payments due. You signed a contract to pay a certain amount of rent a month.
you would need to contact the person you formed the rental agreement with to get them to solve the problem. Should that fail either involve the public health department or terminate your rental agreement, move out and use any evidence to go to either trading standards or the local press. whom I'm sure would have an interest in that type of story

It depends on what state you live in. Most likely the answer is no, and you should consider doing rent escrow where you pay your rent to the court instead of your landlord. That may encourage your landlord to fix the problem. There are a few steps to take before you can do that including being current on your rent. If you contact your local municipal court clerk he/she should be able to assist you with this process. You may also consider contacting your local legal aid office for assistance.
