When my husband and I were purchasing our home our mortgage officer said "Oh my god you are a cradle robber" to my husband regarding the age differenct between him and I. Then, the day we were signing our loan documents she said "If you default on this loan I will castrate you". She also forged documents regarding my husband and I's income so we could "afford" the home? Do we have grounds to sue? |

I don't think you can sue her for what she said to you, although it was WAY over the line, and I would totally write or submit a complaint to her superior and call for her to be fired.
As far as forging documents, I would also take that to the superior, and if you get no help there, I would talk to a lawyer (many have free counseling) to see if a lawsuit is a viable option. |

1. There is no crime against being rude.
2. YOU SIGNED the 1003, so don't go back and blame it on the LO now. Obviously you didn't have a problem with committing fraud or else you wouldn't have closed on the house.
I would keep my mouth shut about the income if I were you, or the bank can sue you for mortgage fraud...b/c you know who's signature is on the loan application that stated "all information is true"?

Why would you want to? If she didn't fudge some numbers you wouldn't have the house... and as far as I know, suing someone for being a ***** didn't count for much. You have to be able to prove damages in order to sue. If you're not out anything, or have benefited from it, you're just gonna have to suck it up and be happy.

Not if you took the mortgage. You would probably be viewed as accessories to fraud - unless you could show you were unwitting (and if you were unwitting why would you know?).
The risque comments of the officer show poor taste rather than something you should sue for in my opinion... It's not like you were defamed by their words... |

On the other hand, you could and *should* report her to your state's Attorney General's office for forging those documents. They'd be *very* glad to hear from you. |

The comments she made are not actionable. People have freedom of speech and that frequently includes the freedom to offend. While it was offensive, you won't be able to sue over it. You need to ask yourself "what are the damages?" and it's unlikely that a judge will agree that you suffered as a result of the statements.
If she forged documents on your loan application without your permission you could sue and press criminal charges. |

If I can read in between the lines, and you are asking if you have a cause of action against a lender for a house purchase to wit at this time you have negative equity based upon fraud and harassment?
Without going into a long dissertation, its your legal burden in court to establish fraud on the documents you signed, in the other complaint note sure if you could even prove it would afford the remedy you seek |

Well lets say her banter was out of line but nothing to file suit upon. Now on the other thing she mis represented your income, but you agreed with it and signed off that is was true. YOU had the opportunity to change that, but did not, the only person that committed fraud was you and your husband you signed that you made that much income on the official papers, and did so so you could get the home. Why? Because you wanted it and it most likely appears cannot afford it. So the person and or persons to blame are yourself. Do you like the house? If so, then everything else can be forgiven. Have you read the newspapers? In Arizona the state is suing 400 mortgage people for doing exactly what you describe.
If you sue in Small Claims Court your limit would be $5,000? WOuld you accept that? Would you ever agree to be on The People's Court? You'd get $15,000 and win your money. The loan person would go so she could get $15,000 even tho she'd lose for cheating you. |

Honestly, I think in general, most peoples' reasons for suing others is wrong and in most cases, I've always found the idea and practice of suing to be so corrupt. However, I would agree that in this situation, being one of the few exceptions, yes, definetly, you have grounds to sue. |
