Can someone tell me if I have the right to put a House For Sale sign on my property even though I am in a Option to Purchase Contract on the property? Also do I have the right to enter the property anytime I want? The property was in a land contract and due to my reasons I couldn't honor it. I then had the people sign a option to purchase contract. It does state that{Occupancy of the premises has been in the possession of the purchasers from a land contract that has been surrendered by the buyers to the sellers, and a leas between the parties entered into in conjunction with this option} I am not sure if the option to purchase would be the same as the land contract in the effect that I wouldnt be able to enter the property. I am not "technicly there land lord" so should I be able to enter the property and put a for sale sign in the yard??? Again the reason for the surrender was due to I (the seller) was unable to honor the land contract. Do they have the right to sue me? I am in financial trouble and I can no longer on the option to purchase now. I need to sell the home now. |

This arises in a transaction that includes a trade-in vehicle when more is owed on the trade-in vehicle than the actual cash value of the vehicle. Generally, a customer is led to believe that the dealership is valuing the trade-in vehicle at the same amount as what is owed (thus the customer won't owe anything on the trade-in.) In reality, the secret actual cash value (the value the dealership is really giving the trade-in) is less than the amount owed. The difference is added to the cash price of the new vehicle (or the capitalization costs of a leased vehicle.) By inflating the cash price or cap costs of the vehicle, you the customer are illegally paying more in sales tax and registration. The dealership may also be violating the laws related to selling a vehicle for the advertised price (a dealership may not sell for more than advertised price.) A similar illegal practice may occur when a lease balance is paid off. These are still illegal practices even when the customer is told what is happening. |

Assuming you are in the US.
You can not sell until the time for the present renter you have either exercises or declines their option. The contract should have a date for that, usually it is 24 months.
As you own the property you have the same rights to enter as any other landlord, this is legally a rental, they do not own a S---.
You can not legally sell the house until their option to buy has past. They do not even need to sue you to prevent that, just present their contract to the title company.
You can't offer it for sale, put a sign in the yard or anything until the option period.
At the same time you do not surrender your basic bundle of rights until after the have completed the sale. You are this landlord, they are renters, but renters with a contract to buy your place ata future date. |

The option to purchase and a land contract are basically the same thing. The purchaser doesn't take title until he gets another loan to pay off the balance. So it is your property. But how you didn't honor it is hazy... however since it is in writing that you both signed that they surrendered the land contract and are on a lease to own, I think it falls under a normal lease agreement. The difference being at the end of the stated time, they have to buy it rather than move out. If they don't have the money to buy, they move out, you keep the payments and that is it. |
