In almost all states that I am aware of a month to month tenancy requires a 30 day notice of termination and for them to vacate the premises, you don't need a reason other than wishing to terminate your agreement.
You need to read your lease terms if you have a written lease and if you do not or even if you do, you need to check your landlord tenant act of your state for what must be in the notice, when to send it, and how to deliver it and all the other steps required according to the law.

I find all the different answers interesting. I am a landlord in PA and belong the Apartment Association of North Western PA. The leases they sell landlords state that a landlord an evict with 30 days notice and you do not have to give any reason. The tenant can do the same with 60 days notice.

If you have a month to month agreement you only require a 30 day notice and you don't have to give a reason. If they do ask, just simply state that you have opted not to renew their agreement. Don't argue and don't let them get you upset. Just sound like a broken record and repeat the above.

However, if they had a lease for a certain amount of time then you would have to have a reason or cause to give notice.

Do you have a written rental agreement? If so, you need to abide by it and give the tenant whatever notice is required to vacate.

First of all, Do they have an actual documented typed lease? Did they sign and agree to a contract with you? Are there guidelines and procedures you have written in your document? Honestly, It's your house and you can throw anyone you want out of your own home. No reason to check "laws" when it's your own property. Also, it's not a court's problem if there is no contract. An owner has sole discretion and you can evict someone for absolutely any reason if it violates any portion of a lease.

Here's a good place to check it but, you have a lease at will if it's month to month unless the original lease said renew for a set time. So it's time to maybe advertise the apartment and give them notice to go find someone else to pick on or complain about. You surely don't need tenants like that.

You will need to check your local land owner tennant laws but usually you have to have a just cause to evict someone and talking bad about you does not qualify.

It most places a tennant in your home will not qualify and you would not be able to enforce your lease.

That being said I'm sure if you threaten her that she would leave and not fight it.

Have to agree with the majority here.

30 day termination notice, without cause or reason.

Just understand that if she doesn't leave willingly per the notice, you will have to evict through the courts.

There is no legal defense to fight an eviction when it's a termination without cause.
