mrcsgrl | Do I have to use this real estate company if they let me see the house? |
I was driving a neighborood and saw this cute house for sale. I don't have an agent yet, but have somebody in mind I want to work with, but not yet. Anyway, I was thinking about calling the company /agent on the sign to see if I can get in to see the house. If they allow me to go in and see it, and like it, am I obligated to buy the house through the listing agent, even though I didn't hire them, or can I bring my own agent in to write the contract on the house if I want to purchase it? Thank you! :) Additional Details I haven't hired an agent yet, but I know who I want to use. I didn't want to bring anyone in yet to the sale, though, I was kinda going to open houses on my own first. |

IMO it is unethical to use one agents time and resources and they give the commission to someone who was not involved with the sale at all.
If you want to use your own agent you should have THEM showing you the properties, not taking advantage of someone elses time. |

No you are not obligated but it would be very rude to make the listing agent take time out of there day to open & show you the house & then you use someone else. I would also never advise you to buy using the sellers agent- they work for the seller, the seller pays their commission so use your own agent. If you have someone in mind then call them & they can show you the house. They also get paid by the seller but are working for you.

mrcsgrl, I'm not sure what State you are in and some laws vary by State and even local real estate board.
In general, you should not see ANY home without your agent.
You may be placing yourself in a very sticky situation called Procuring Cause where the agent with the home can say that their advertising was the initial reason you found the home and be able to produce information like a cell phone photo or drivers license number. Some can even use computer records to prove you were on their websites.
Speak with the agent you want to work with and then speak with at least two more. Start by reading the information below from the National Association of Realtors on the CORRECT steps to take before buying a home. |

You are not obligated to use the agent. But, I think that if you call the listing agent (number on the sign) and she makes an appointment to show you the house, which means she has to drive out there to show you...and you like and want to purchase it...out of courtesy of that agents time, you should use her. But if you just call on the phone to find out information about the house, you are not obligated to buy the house through that agent. You can view it with your own Realtor. |

No you do not have to go through that ral estate company/agent if you call them to see the house. but I would let them know that you are planning on using someone else. (You don't have to tell them who) just that you have someone in mind. If you are going to use the other agent to make an offer on the house they (the agent) should probably see the house as well. An agent will be able to ask the questions that need to be asked, as well have some opinions regarding the purchase.

Look on the sign for a "MLS (Multiple Listing Service) Listing agent/company" logo. This means that you can use your own agent (when you decide on one) to look at different properties. |

Not really agents are just that agents. The seller has one and the buyer can have one. they normally split the commission, but use who you want as your agent, in fact it is not good to have the seller agent be the same as the buyer agent as it represents a conflict of interest. ie are they pricing for you or the seller? |

As long as you don't sign a contract with the agent, you can use any agent you want. Normally, agents want you to sign a 30 day contract. |

You are free to choose whomever you want. If you like the house, contact your agent and have him or her put the deal together. If you are seriously looking, you should just go ahead and get them signed on anyway. |

It may depend on the state. Where I am licensed we are required to give them a written description of the type of agencies we offer( such as buyers, sellers, dual, sub agent, transaction broker) and how we would represent them. This is to be done as early in the process as possible. Meaning, if you where to call me about a listing of mine, before I showed it to you we would have an understanding of our relationship.
Where I am licensed if you produce a willing able buyer you get the commission. Meaning any agent shows you the home and you buy it, whether or not you have a written contract one is implied and that agent is due the commission. In my area what usually will happen to avoid problems is one will pay the other a referral fee. It could possible cause problems at closing if the Realtor pushes it.
If you want to use a certain agent contact them about the home. |

as long as you do not sign a buyers agent agreement with the listing agent you can use your own. However, if I were you I'd go ahead and talk to the person you want to use first and just let them do the walk through with you. Your own agent will be more apt to show imperfections or flaws in the home that the listing agent will not since they are solely working for the seller. |
