Do I still pay my rent if Landlord is in Foreclosure?
Okay, it is November 10, 2008 and according to the papers the court server just dropped off my landlord has not paid his mortgage since June 1, 08. I have tried to contact my landlord to find out his intentions, to no avail. My rent is due now and I don't know what to do as he is not answering my call. I have nothing on security with him nor am I on a lease I am month to month. Please tell me if I can take this months rent and put it towards a new home for my 2 daughters and I. Of course you have to pay the rent. Just because the owner is having problems paying his loan does not give you the right to stop paying for rent.

That the landlord is facing foreclosure affects your renting rights or responsibilities in no way whatsoever. It is now November 10, and you will owe rents to the landlord for November and December if you provide notice of intent to vacate in writing between now and November 30.

Since you have no security deposit, you have no worries about whether or not that will be returned to you.

Start looking for another place to live, but continue to pay your rents as they are due. I somehow get the feeling that you think you can live where you are free for a month or so, using your rent money to find yourself a different place. That is NOT true, and this landlord could take you to court and wreck your credit if you try such a silly thing.

I suggest you contact your local tenant's council, or legal adviser to determine if your landlord still owns the property, or whether or not the property has been foreclosed already. Take the notice that you have received. That is the critical point.

If the landlord still owns the property, I think you still must pay the rent you owe him. I would also suggest that you find another place to live and move after giving your landlord the required notice. Your agreement to pay him rent was not contingent on him paying his mortgage payment on the property.

If the property has already been foreclosed - I think your legal adviser would tell you he no longer owns the property and you are not obliged to pay rent to him.

So find out what is going on.

An attorney told a group of us that we didn't need to pay the rent. But this is what you need to know now; #1 does your state have the "right of redemption?", call the assessor's office, #2 when is or was the sheriff sale date, if your state has a right of redemption period, then you have that time to find another place to live. If they don't have the right of redemption, you need to begin your search now and move soon. You may not be given but 24 hours to move. So don't wait.

The relationship between your landlord and his lending institution has no legal bearing on your duty to pay rent.

Until a foreclosure has finished and you have been legally notified to pay your rent to a new entity, you MUST pay rent to your landlord.

Similar thing happened to us. We moved into our new place the last week of July. We realized we weren't getting any mail and called the post office, turned out that we had one of those locked community mailboxes down the block (the kind thats like a big case of little locked boxes) and we had to apply to get our mail. It was september before we got into it, and we had a mountain of mail, including mortgage bills and notices for unpaid mortgage and utilities, that were postmarked as early as FEBRUARY. We got really worried about whether we would have things like heat and water cut off, or if the house would be foreclosed. We just waited and as of October first the house was sold to a new guy WITH our leases, so it didn't affect us at all. A similar thing may happen to you, so just save money, enough to move if you need to, because if the house if foreclosed, there is no lease to carry over and you will most likely be evicted. Find a new place and give your notice, and hopefully you can have enough saved to not get stuck without a house.
I guess if he doesn't want your rent though (hasn't come for it, not picking up calls), then you could find a new place and basically just vanish...

stop paying the rent, but put it in a escrow account, or at least don't spend it, because eventually you have to pay it, but the way it is now, you may end up paying twice, better yet look for a new place to live, because you may end up being evicted anyway.

nope, yu can pocket that money and even stay in the house until the bank serves you with eviction papers and even then yu maybe able to negotiate with the bank for them to pay you to leave sooner for your expenses. but be ready for anything and pack up your belongings asap.

If I were you, I'd start looking for a new place to live, and fast. Your landlord has obviously lied to you about this situation and you are now in a very tight spot thanks to him.

However, try calling your local magistrate and asking about the laws there regarding this type of situation. Explain to him/her that your landlord has not paid his mortgage on the home you occupy since June and you weren't informed of this until you were served with papers by the court. Ask them if you should still pay this month's rent, or just put it toward a new place since you may be forced out of your house soon anyway. They'll be able to give you the best advice in this situation.

By law you have to pay rent. The contract for rent was between you and the owner of the home. Not between you and the bank. The landlord has the right to come after you for the rent if you stop paying. That is until the sale of the property when it transfers to the new owners in this case the bank. When the Deutshe takes over ownership you will have 30 days to get out unless the sheriff stalls for time for you. I would start looking for a new place. Good Luck

I had this happen once. When we got the papers, we started to save all the money we could. Looked for a place. The court or mortgage Company will give you a date. We stayed rent free for 2-3 months.
-but don't Always count on it being that long. Save the money, & move when you have enough.
