Do both occupants have to sign a lease for an apartment?
I'm having a little problem with a tenant. He's broken about every term in my lease and he's saying that even though HE signed the lease, because his financee didn't sign the lease that it means nothing...is this true? What can i do to get this guy out?!!
It is your house. It doesn't matter who is on the lease. If the lease has been broken, it is void. Evict the person that is on the lease - they are the only person who has a legal right to be on your property. As soon as you evict, their legal right ends. While you are evicting the person on your lease, also go the extra mile and evict everybody else at the same time just to head off a potential screwball ruling from a liberal judge.

Evict them both. You don't need a signature to do that.
You did not say what state you are in. In CA this would not be true, you do not need her signature to enforce the lease.

He has another person (who is not on the lease) living there. Plus you say he has violated the lease many ways. If that is so, you have cause to evict. Google your states landlord-tenant laws and proceed with lawful eviction.

It's against the lease for some one over the age of 18 to live someplace without signing the lease - which only really matters if the landlord enforces it
and it does mean it - his fiancee shouldn't be living there, and the one person on the lease has broken his agreements - you've every right to kick him out, even without notice.

You don't really explain the problem Is his girlfriend living there? A person cannot stay more than 3 weeks in a row if they do they are not considered a guest and you can make her leave and then he will. Just tell him she needs to be on the lease or she cannot stay and if she is on the lease she has to pay 1/3 So try that.You can give him an eviction notice if the girl has been there more than 3 weeks Hope that helped

if only he signed the lease he is liable for every term in the lease . the lease is still valid . see your Solicitor or Citizens Advice Bureau
