It is now July 2nd I just heard the landlord knocking on the door for his rent. We have now lived here 4 months and paid on time every month. When we looked at the apt complex he specified that there was a laundry room around back. I even asked him a second time where it was since we have 2 kids and had a third on the way. We since found out that there is NOT a laundry room at all and have also asked for other repairs that are stated in the lease as his responsibility but they have not been fixed. I have been on maternity leave now that our new baby is born and my husband refuses to pay the rent this month. What should I tell the landlord since he always shows up when my husband is at work and I have to look like the loser? DO we have to pay or can we tell him we wont until things are fixed?

The other things that need fixed includes the termite like bugs that are outside the door. In the 10 seconds it takes me to unlock the house the are already covering my legs...also we just found out he is being sued over the water here because it has been mixing with the sewage water, and before that he was "recycling" it. MY KIDS DRINK THAT WATER!! When they found out it was mixing with crap water the tenants werent even informed! Also when we moved in there was a problem with the last people and their electric so we couldnt get it turned on for 2 1/2 months bc he jerked around on it for so long. I figure we have waited for everything so long that he can wait a bit...Im sure I could go on and on |

You should have a copy of your contract, take a close look at it. Is it just him that owns the building, or is it owned by someone else and he is just the caretaker? If it is owned by anyone other than him, give them a call. Other than that, I would think that the reasons you cited would be sufficient enough to break your lease with no penalties if you are unhappy there, but I don't believe that you can just stay and refuse to pay rent. He can definitely have you evicted for that. Good luck, I hope everything works out for you and congrats on your new baby!
EDIT: Those are some major health violations, and nothing to mess around with. You need to contact the Board of Health immediately. Do you want your kids living there? They will most definitely shut him down and probably make you move until the violations are taken care of. You will also probably be able to sue in small claims court and make him reimburse you for any expenses you incure while finding other housing. Get out of there before your kids get sick! |

You cannot withold rent. However, you can break the lease since it was a false contract. You can also sue for misrepresentation in small claims court. However, if you withold rent, you will be evicted and won't have a leg to stand on in court. |

i did that with one of my old landlords (exact asme situation) and she returned aout 2 hours later with a 3 day eviction notice....good luck though

most leases have a 5 day grace period for rent payment... check over your lease for any information on that |

yes, pay the ******, but also go and file court papers showing that the landlord has breached the lease agreement
by not following the terms of the lease. keep EVERYTHING in writing. if the lease agreement says that there is a laundry room ON SITE and there isn't one just one close by, then he is in violation of the lease. just a word to the wise.... it is always better to rent/lease from a company than an individual. |

but you should pay him because you can take your clothes to your closet family members and wash your things there cause thats what we do but if your tried of him you should move before the baby is born |

If you withhold rent you will get evicted for non-payment.
Send a certified letter of everything that needs to be taken care of. he then has 30 days to get it done. If he does not, then you can havea licenced contractor take care of it and deduclt ONLY that amount from the rent.
I need to save this so I can just copy it next time....man I'm getting tired of answering the same question over and over. I'm very sorry if I'm a little rude but it needed to be said. |

Nobody can make you pay the rent, the same way nobody can stop your landlord evicting you, then suing you for back rent . Next time you rent an apartment go through the entire unit to see what is what, then go look at the other amenities just to make sure. |

Wow, that a hard situation. Why didn't you make sure there wasn't a laundry room before you got commited to paying the rent for the house? Anyways that is not the problem now...
The next time the landlord comes to the door, I would talk to him, and tell him that you will not pay the rent until he repairs everything, afterall that is one of the responsibilitys of leasing a house. Or you could say either you repair everything that needs to be repaired and then we will pay you the rent, or tell him that you and your husband will repair everything and pay for it with the money that he WOULD be getting if you paid the rent. Just remember to be careful what you say because you wouldnt want to get kicked out with a baby on the way.
