Thinker | Do we legally have to pay rent while living with parents? |
I am 21 and finish uni next month. I'm living with parents in a council house, parents are on housing benefit and dont pay rent. Legally, would i be required to pay rent after completing full time education, and unemployed? I understand i would be paying council tax but just wondering about rent also?

I work for housing benefits, if you have an income and you parents claim benefits then under the benefit rules you are expected to contribute to the costs you would be classed as a Non dependant, so not depending on your parents to support you
HOWEVER!!!!
If you are unemployed you should sign on for JSA, then there would be no charge for you living there as you are under 25 and on JSA, so you will not need to pay rent or council tax contributions at all |

No you dont have to legally pay rent, however, by staying with your Mum you may be affecting her claim for housing benefit. Not only has got to bare the financial costs of you living at home again with a rise in her home running cost but a reduction in her benefits, its a lose lose situation for your Mum financially.
Furthermore, although legally you dont have to pay rent if she decides not to ask, she is within her rights to say you cant stay if you wont/dont pay.
She is under no legal obligation to provide you with a home at all. Its permitted for her to tell you to leave if you agree to pay rent and fail to do so, she can also insist on rules that you have to comply with in order for you to stay in the home.
She can charge you, whatever she feels is fair, the fact your unemployed may mean a lower rent, but once your earning a wage she may decide to increase it to a more appropriate level, to take into account the gas electric phone and food |

Your parents will have to declare your presence in the house to the benefits office, who will expect you to pay your share of household expenses (including rent) because you are an adult and legally responsible for your own life. If you don't get a job and apply for benefits, that will all be taken into consideration. There's no such thing as a free lunch (or dinner, or tea, or lodgings). It's time to grow up and shoulder your responsibilities. |

When your parents have someone over 18 who is living in the household they get a non dependant reduction, because they see it as you should be contributing to the house hold costs, so your parents will receive a lower amount of benefit because you are living there so legally you dont have to pay rent, because its your parents choice whether you pay into the household costs or not |

Visit your local council's website. Your parents must complete a change of circumstance form once you finish full-time education. They will then inform them of whether there are any changes to their benefits. |
