The landlord should have over your rental agreement with you item by item. Most agreement will state if you add a person the rent will go up XX dollars. Our rental agreement states that the rent will increase by $100 per month. They must also qualify to live there by completing a credit application. If they do not qualify and you are a good tenant, the owner might require for them to pay an extra security deposit.
By law all people over the age of eighteen must have their names written on the rental agreement. If one person moves out of the apartment, the remaining tenants are responsible for the rent. |

Check your lease out. The landlord rented to one person, not two. You can ask them if it is okay for someone else to move in with you but they might no agree. If they do not agree or if you just move that person in without permission, they are liable to evict you. |

They could evict you both if they find out. They have a right to know who is using their property and how many people. Overnight visitors may be allowed for a week or two, but after that they are usually considered tenants. |

Check your lease. Many leases require that all occupants age 18 or over must be on the lease. If yours does, then you'd have to. The definition of "occupant" (versus someone who just stays over from time to time) varies, but sounds as if your friend would be an occupant.
Also, many leases specify the maximum number of occupants of a unit. If yours limits the number to one, then you wouldn't be able to (without written approval/modification of the lease) from the landlord.
So: Read your lease. See if it'd even be permitted. If so, see what conditions, if any, you have to follow.
What if you don't tell them and they find out? If your lease limits occupants to: (1) one person, or (2) just the people who have signed the lease, then you'd be in violation of your lease. You'd have "broken" your lease, and the owner would be within his rights to evict you.
So: Read your lease. Understand what it permits you to do, and under what conditions. Then follow what the lease says. Otherwise, as noted, you'd be in violation of the lease and could be evicted.

Hello I am a landlord. The main thing I care about is getting payments from my tenants on time, and that we are on good terms. I am not that concerned who is living there (except for the main person on the lease) as long as the payments are timely and the place is kept in good shape. Besides I have no reason to visit my tenants unless there is a repair so I really would not know.
However some landlords may be strict if there are way too many people in the place, the people seem unruly, or if someone files a complaint. Also for liability reasons many landlords may enforce the lease to the letter.
If I were you I would let your friend move in, make timely payments, and don't mention anything. If the landlord does happen to question you, you can say that the person temporarily was staying with you and you were thinking of moving out to find a new place. Or something like that.
Only if concerned he may add the other person to the lease, possibly charge more, or ask them to move out. Or he may just forget about it because he would not want you to move out for sure.

in college i lived with my friends at their apartment for like 3 years and nothing ever happened because the only way for them to find out is if they paid frequent visits to your apartment or checked your mail and said who's this? if the property managers are cool then nothing to worry about. |
