In your case, yes. Placing a deposit means you have secured the property, ie, it is effectively yours, no other person can view it, and the landlord should remove it from the rental market.
Relevant checks are then done on the prospective tenant - these usually include credit history, and references from previous landlord and/or employer.
If none of these checks are acceptable to the landlord, or for any reason he is not happy with the possible tenant, he can decline their tenancy but must return the securing deposit. He may deduct a holding and/or checking fee.
Don't fret too much about failing the credit check, some landlords are more fussy than others, plus there is a slight possibility he declined you on purpose, for his own gains...
Obviously at this stage, no tenancy agreement has been signed, but please tell me you have a receipt for that deposit... |

Um, people... She's not talking about a security deposit paid after signing a lease! She's talking about not being approved based on the credit check, changing her mind, or not being able to move in for personal reasons. She didn't say which so I'm throwing them all out there.
If it's because the landlord won't approve you, you are entitled to the deposit back. If it's because you changed your mind or something on your part, you can get it back if it is within the time period specified on a hold agreement you should have signed and received. |

I would have to say you get your money back minus a small fee for him having to have it off the renting market while he checked your credit and such. Look up your local renting laws. I believe california says you get it back minus some for liquidated damages. I could be wrong. check it out. |

whilst still renting no,once you cancel your agreement to rent and leave the property will be checked over and repairs made,best idea is to take photos of the rooms etc if in good order they will refund your deposit if not they are entitled to claim at your expense the land lord is entilted to charge for anything that requires repair that you have used, |

I thought you only got the deposit back if you were leaving that property and the landlord had been round to check that everythng was ok and nothing was broken etc. The point of the deposit is so that if you wreck stuff and leg it the landlord has some money to put it right and its and incentive for you not do that. |

Absolutely, within 14 days of vacating the property in the UK I think, with any deduction as per the rental agreement if you have one. Wear and Tear are not your responsibility nor maintenance of equipment.
If you have an issue with the return of the deposit in the UK, know that landlords, private or agency, are bound by law to keep the deposit in a separate account and declare earnings to the Inland Revenue (in the UK). Going legal is expensive if you have an issue although the Small Claims Courts are an affordable option. Usually, the landlord won't like to have a bad credit record himself so he should accommodate, if I dare say.
