Does a first months rent get refunded at end of contract..?
if its been paid already... ok, so when i moved in i payed £700 deposit, and £700 months rent in advance.. i claim housing benefit because im a single parent, and i DO work, part time so get help with rent.. so the first months rent was paid by both housing benefit and me.. even though i gave £700 in advance. Do i get this back at the end of my contract. or do housing take it back. My landlord insists i do not get it back only the £700 deposit i get back. I do not understand why she should receive two months rent for one month? Is she right, or am i being stitched up. Thanks in advance..

Margaret.. housing benefit is not paid straight to me.. It is paid by cheque to the landlord. It may have changed now, but i have lived here 2 years!

You always paid the rent in advance on a rented property, so when you paid the money on move in that was to cover the rent until the next rent due date, when you pay for the following month. The housing benefit usually take about 3/4 weeks to set up so they usually start paying as of the next due date (month after you moved in). This means when you move out of the property housing benefit will still pay another months rent which you get to keep, as this pays you back for the initial months rent you put down on move in. You need to go to the benefit office and ask them for a print out of all payments made to your landlord, You can then check out the payments and you have evidence for the landlord if they require it.

Be sure the Housing people know that they took money from you as well. The landlord may be double-dipping.

Well as any 'housing benefit' (now the LHA) is paid directly to you not the landlord how did the landlord end up being paid twice for month one?

You only get your deposit back. You paid the first month's rent in advance, but you lived there during that month didn't you? So why should you get it back? In fact, when you paid your second month, that was in advance also. So according to you, after 1 year you should get back $9100.00. Doesn't sound right to me.

Provided you leave the property in good condition when you vacate it, you should get your deposit back.

In reality, some landlords will find a fault so that they can keep the deposit.

The bond is something you should get back. Rent is usually paid for in advance-I'd advise that when you move out you do so on the last day of the month so that you get your full money's worth of rent paid. If you paid a bond after April 2007 then the landlord should be holding it in some kind of Tenant deposit scheme (in UK) which you have a legal right to be informed of. This is an impartial body which holds the bond and settles any disputes when a tenancy ends.

Check your lease, but your deposit should be returned less any monies for rectifying any damage caused to the property (not wear & tear - the landlord claims for this in the normal course of duty) and possibly for cleaning the carper/curtains - again, check your lease.

Regarding the first month's rent - I reckon that he is trying to fiddle you and keep both sets of money but check first with your lease that you didn't have to pay a month in advance as well as the social housing benefit having to pay a month in advance. If this is not here, confirm with the benefits office that they did pay a month in advance as well to make sure that you have all the information checked and to hand. If nothing about needing two payments is in the lease, write to your landlord succinctly and specify what you understand to be correct and ask him to confirm in writing that you are correct or whether there is still a discrepancy. If there still is, try getting legal aid.

Alternatively, and you may be more comfortable doing this - contact the Citizens Advice Bureau, who offer a free, confidential service and ask them - they can check your lease for you and if need be, refer it onto their own solicitors to check it out and write the letters for you. Questions like this will have been dealt with beforehand within the CAB and they only do what you are comfortable with.

You will get your month in advance rent and your deposit if the rented accommodation is in the same condition as when you moved in.

In my experience you will always loose some of your deposit, they are very particular.

In theory, you will receive back £1.400 if there are no damages. Ask your agent to make sure.
