Julie K | Does a landlord have the right to know the identity of my visitors? |

They only have the right after 2 weeks, when their property becomes the visitors legal residence. |

nope.. it's like an invasion of privacy... the landlord really had no business to know who is walking into your apt |

It depends on how many nights a month they sleep over. Check your lease. They do have a right to know depending on how many nights they are there.
They have to consider Condo or HOA rules. Some places require tennant approval for background checks. Your owner could be sued if there were an unknown felon or predator living in the community. |

I'm a landlord and I say no.
Too many landlords try to put it in the lease, and legally, it's not enforceable. It's none of their business. |

Define "visitors."
Someone staying with you overnight or longer in your rental unit? Someone dropping by for coffee? Someone delivering crack? Someone leaving their tractor-trailer idling while you watch a football game together?
Many leases are written so that a "visitor" staying two weeks or more must be identified and possibly even approved by the landlord. Any other restrictions will be written in your lease.
If there are no other restrictions in the lease, THEY DON'T EXIST. |

I would have said no a month ago but here is what happened to me.
In Jan 2007 I rented an apartment and every time my Grandchildren who were an infant and a 2 year old came to visit my landlord would tell me they had to leave. He even went so far as to give me a written note telling me the kids were not allowed on his property because it was not safe and that he did not rent to people with kids. I moved out and filed a claim against him for discrimination with the local HUD who are supposed to handle landlord tenant problems in NH. After 10 month HUD notified me last week that I do not have a calim. The landlord can force his tenants to have no children as visitors because the only law he would be breaking would be if I was the legal guardian of the child. Otherwise he is within his rights to not allow children to visit his tenants.
So based on that I am sure your landlord is not breaking any laws by asking for the names of your visitors.
It is amazing the rights we THINk we have!! |

It depends how long they stay. If it's more than a week or two they could be considered additional occupants. |

No, not unless they are extended visitors are defined by your rental agreement or unless they are engaged in illegal activity that might compromise the owner's legal rights ie like dealing drugs or running a prostitution ring out of the house.
Most agreements I have seen mention guests. As long as they are not creating a disturbance, engaging in illegal activity or living there full time, the landlord is overstepping. You have a right to full enjoyment of the property you rented and that includes reasonable guest visitation. |

Not unless they are planning an extended visit. I would say a guest staying 2 months or more.(that is only in case you have an emergency, the landlord will not be surprised if someone else answers the door!) Otherwise, It is non of your landlord's business who your visitors are. That is a total invasion of privacy. |
