Does a landlord have the right to tell you to "move out" because he doesn't like you asking for repairs?
My landlord told me by phone to "not say anything" with the city inspector comes. I assume the city inspector would come alone, not with the landlord when doing the inspection. There are many things that didn't get noticed and they really didn't look at much of anything. They missed so much

-non working stove
-electirc outlets that won't hold a plug (it falls out)
-no working phone line
-exposed wires in the closet that don't seem to have a purpose
-rotting wood under both kitchen and bathroom sink from -water damage due to leaking pipes
-Water damage on the bathroom ceiling from unknown source
The inspectors came in and out in under two minutes

I did ask the inspector if he saw the water damage and molding under my sink only than did he take note of it, he never went in my bathroom. The landlord knows of all of these requested repairs and has had them in writing for two years now, claimed he didn't see anythign that needed to be fixed.

His reply has been " move out"

So when I asked him to please ask my neighbor to be consideration at night with his moise level, he went on and on about the inspection and that if I'm not happy I should move out. I don't think a landlord's response to any "problem" really just a request to be "this is tashma hall" if you dont' like it move out. is that normal that the need to fix something that has been damaged for years be acceptable. I just want it fix than I never would have to ask. I put in writing to him the day I moved in (because he won't let me do a walk through) I thought an inspection would help me not make the landlord that much more retaliatory.

What would you do?

No, retaliatory eviction like that is unlawful. There are lots of low cost tenants attorneys out there, get one--you should be able to get your landlord back in his place, or at least get some cash for moving someplace better.

contact your local housing authority-report the landlords request that you shut up or move out and see what they say-in some cases you can put the rent $$ in escrow until repairs are completed-but you must follow local/state law

It depends on if you have a lese. If you are month to month he can ask you to move out at any time.

I take it you are section 8, otherwise there are no inspections. Since you don't pay any rent I do not think you would have a lease.

Some of the things on your list don't matter at all, some are your responsibility, a couple are the landlords.

You may ask your social worker to find you another place.

I would wait until the inspector makes his report before I worried too much.

You were most likely asked not to interfere because you would have wasted everyones time.

What is covered during a welfare inspection may vary by community. Where I am the rotting wood would matter and MAYBE the water damage, but only if presently wet. Stains on the ceilings are cosmetic.

I'd say, if you can afford it, move out. If you have wires in your closet and you don't know what they are, that can be a safety issue. If your apartment is like that, how many of these other apartments are the same? How long do you want to wait before there's a fire or you move something and get electricuted?

Another thing you should consider, were those things like that when you moved in? Were they documented? The landlord should have walked through the place with you and documented things that were damaged when you moved in, and given you a copy of the list, so when you move out they can not deduct those from the security deposit.

If you wish to stay or cannot afford to move out, write to the landlord and keep a copy for yourself, listing the problems you are having. He may not take care of the rotting wood right away, but the electrical stuff he needs to take care of pretty quickly.

All in all though know your rights and see a lawyer, most have free consultations.

P.S. Don't withold rent without seeing a lawyer first, or suing in court, as you don't want him to have any excuse to evict you before taking legal action.

Check your lease, this is where slumlords get you. Read your lease thoroughly, some guys actually put it in the lease that YOU are responsible for repairs, and once you sign it, you're SOL. Also, when you first move into a new place, you should always do a walk through, and take notes and photos. Make sure he is aware that something needs repair, and you expect him to do it. Have it written onto your lease what needs repair, and that he will do it. It's his responsibility. Give him no more than 30 days to fix any problems. NO MORE!!! At this point, he is violation of your lease agreement. Hammer him. Check your local laws to find out what your tenant rights are, and what his landlord responsibilities are. Never renew a lease when there are outstanding repairs not being made. No, a landlord can't make you move for asking for the repairs, but he can say, "If you don't like it, move." And obviously, you don't want to keep living somewhere like that, not matter how cheap the rent. Remember, you get what you pay for. Report your land lord to the health department, housing authority, and IRS if you want to get even. And in the future, do a detailed walk through. Here's some things to look for:
- Are all the covers on the electrical outlets, and light switches?
- Do all the appliances work properly? Test each one.
- Are there excessive nail holes? If so, make sure the landlord documents this on your lease, so you don't lose your deposit.
- Is there water damage any where? Look under all the sinks, and check for "soft spots" in the bathroom floor around the sink and shower.
- Is there a smoke detector?
- Are there any general construction issues? Loose boards in the floor, holes in the drywall, etc.
- Any sign of pest infestation? Look for mouse holes/droppings, and look inside drawers, behind the fridge, and in the back of cabinets for roach signs. Note that roach droppings are orangish in color, and look like dust.
- Check inside closets for damage.
- Make sure all doors and windows operate porperly, as well as all locks and door knobs.
- Finally, check out your landlord. If you're renting from a private individual, make sure he's legit.

Withhold your rent. If you have asked for repairs and have given him ample time to respond to your complaint he has broken the contract, assuming you signed a lease.
He's not holding up to his end of the deal so you don't have to either, stop paying rent and continue to request repairs - in writing.

Yes, the landlord can be there during the inspection. However in your case, since the inspector missed so much, sounds like the Landlord got to the inspector ($$$) before he even stepped in the house. The landlord can tell you to move out, but you're not required to move out unless you're in violation of the lease.

I think your best course of action is to contact legal-aid and ask for advice on the best way to end your lease and move ASAP. If you just move out like your landlord says, without formal notice, he might still hold you liable for rent due on the remainder of the lease. Good luck
