Of course it depends on the laws of your particular state. In Texas, the answer is yes. You don't have to disclose death by natural causes. It is, however manditory to disclose any death by voilent means. |

Like most Real Estate questions, the laws vary from state to state. In California, the sellers must disclose any deaths that have occured on the property in the last 3 years. However, if anyone asks the sellers or the agent direct questions related to deaths, they are obligated to answer truthfully if they know of any deaths that have occured. Many times sellers will have no idea if any deaths have occured, and thats OK, its not something you have to research, its OK to say "I dont know".
One caveat to the whole death disclosure thing... I believe they are not allowed to disclose AIDS as a cause of death. Anything else you must disclose (murder, suicide, natural causes) but AIDS is off-limits. |

In the state of CA you must disclose any death on the property (even if someone died in their sleep of old age) if it happened within the last three years. If it happened longer ago than three years the agent doesn't have to mention it unless they are specifically asked, in which case they have to tell the truth. |
