legal? i think i would ask --does anyone want to live in a house built on a graveyard? ahhhh. sounds creepy to me....
but legal....geeze i would check you local laws...and i would check back on dormant laws that are on the books in that area.
you know ---its not legal on indian territories...but american soil....i just think it is gonna be based on local law.

Developing or building upon property which has been used for burials is generally speaking illegal, when the developer/builder knows or should have known, that the site contains human remains. There are obvious reasons for this, not the least of which is the respect our society has for the deceased, but also, there may be historical/archaeological issues, and in some instances, there may be a question of whether a crime was committed. Obviously, a known graveyard would not be zoned for any type of development unless the bodies could be removed and relocated. If, as is more often the case, there are not obvious signs of a graveyard, the builder/developer cannot ignore evidence once it becomes apparent or would put a reasonable person on notice that they may be disturbing a gravesite. At that point it is generally the duty of the builder/developer to contact the local authorities and state agencies, let them conduct their research and determine whether there are remains and how best to deal with them. |

Wow. I'm an agent in Myrtle Beach and this is something I would definately disclose if I were the listing agent and knew about it. I would call the Real Estate Commision to know for sure as I'm sure if buyers knew this they would shy away especially since there seems to be some legal issues already involved with the property. And as far as the price real estate in SC has gone up that much in six years so the price is not surprising to me for the land. However, knowing about the history of the land to me would make it not be worth that much at all. |

Did you see all the trouble it caused the owner's in Poltergeist!!?? EGAD!! Would assume it is illegal not to disclose that information. Like not disclosing your basement has a water leak or something. In this case, a ghost leak.

How do visitors to the graves place flowers on the graves when there is a house on top?
When visitors wish to be with their deceased loved ones, do they go inside the house and sit in the living room?
Has the owner of the house so rudely built on top of the graves been paying rent to the grave owners for the privilege of encroaching on the space above them?
Do the grave owners have an easement to access their property in case an exhumation is required?
With a house on top of them, how do the occupants of the graves get out to stretch once in a while?
