Does anyone know if there is anything i can do once a sheriff has served a vacate premises notice?
ok. back in oct. of 07 our 1 yr. lease was up. landlord wanted to sign another 1yr lease but we refused b/c we were in the process of trying to buy a home. well, went to court to try to get us out of premises in jan., and we agreed that on feb. 29 we'd be out of home. we haven't vacated, but we did pay march's rent. i've checked continuously at sheriff's station to see if they have filed a notice there, but nothing yet. i was wondering if we have paid rent, and they do file w/sheriff, is there anything we can do to fight it or delay it? we have 3 kids, and there's not much to rent for that family size right now around here. our plans w/the home fell through b/c someone put a heck of a lot of money down and bought it! can i file a motion to appeal, or anything? don't know if they haven't accepted rent payment or not. please respond asap!!! thanks!

ok everyone, the house that we were trying to buy, didn't go through b/c we hadn't signed papers yet, and we were waiting for approval from the fha. so the house was still up for grabs, which in turn allowed for someone else to buy. we knew this, but just hoped that we would get approved and buy it. we were really hopeful, but it didn't happen. therefore, we informed our landlord who didn't care, and wants us out, i'm not quite for sure why, and now we are where we're at now. there was a fax to our lawyer, who i have not been able to get ahold of, which is why i'm on here, that said that we agreed to be out by the 29th, didn't, and also paid the rent for march. please inform your tenants of this and to vacate the premises. it says nothing of whether or not they accepted the payment for march. it was paid in a money order, and i cannot find anything out throught their lawyer since they have to talk to our lawyer and well....

well if the landlord excepted payment that dissolves the previous arrangement. but if you get served papers while your rent is paid up id walk into your local courthouse and ask for an emergency hearing. make sure to keep and collect receipts.

Unless you have proof that rent was accepted, the check cashed you have to leave. Period. YOU personally agreed to this at your court date. You can not force yourself on the landlord, there really is no turning back.

You not only have been evicted, you are now facing contempt charges.

You have had since Jan to find a place. Since you did not you should put your stuff in storage until you find a house to rent, or simply rent whatever you can find. You may have to pick another town if there is nothing where you are.

It seems to me you have 2 options:

1) Vacate the premises

2) Go to jail

i think you need to try and work this out with your landlord. if they do not accept the payment they can have you removed.

if you get vacate paper you have to leave period. so i would be careful what you do. if you are there they thow the stuff out and its horrible. there is nothing you can do period.

If you didn't sign a new lease then you are tenant at will.. If your landlord accepts the rent for this month then you have until the end of the month. But you have no guarantees that he will accept next months rent. I think that you need to communicate your situation better with your landlord. If you had a bid in on a home that you were expecting to buy and it was accepted, no one else could have taken it from you by out down paying you. This doesn't make sense.

Wow I don't know what state you'll and but here in Texas the landlord always win the court give you five days too find you some where else to move if not the landlord have the right too put your things out on the streets good luck too you and your family

The only thing to do is to move out!!!! and fast otherwise you'll end up under a bridge...

You should have filed an appeal before the Sheriff became involved. It is usually costly to do so, but that would have given you more time.

If your landlord accepts your March rent payment, the judgment against you becomes null and void; otherwise, you will have to move or be thrown out by the sheriff.

I know if I were a landlord and someone was extending, I would be happy that it was still rented out, especially if you were still paying rent. Unfortunately the only way to delay it is sign another lease. Hope you can find a new home soon or get it resolved. It's going to be hard to find somewhere else too while house hunting with a short term or no lease agreement. It sort of sucks to be stuck in the middle.
