Does anyone know where I stand on this?
I had a standing order from my savings account to pay £300 rent per month to my landlord. When I moved out in March I cancelled the Standing Order by putting it in writing to the bank. However, they still took £300 per month out until July when I closed the account. I have filled in a form at the bank to reclaim some money, but it doesn't look hopeful. I cannot contact my landlord as he has moved and have no forwarding address. Thanks in advance for any help x

as long as you have proof that you can cancelled the standing order with the bank they are at fault and they should pay the money back to you its not your ex landlords fault that the money was still being paid to him but i must say he is very dishonest .. good luck

Take a copy of the letter that you sent to the bank in March and go to your branch and speak to the manager. They have taken money from your account after you have requested that they stop, so they should refund the money to you. You do not have to take it up with the landlord. If the bank manager does not agree to refund the money to you then you will have to take some legal action, in which case you should contact a solicitor.

they have made a payment on your behalf without your consent, you are within your rights to demand the bank repay that amount to you and contact the other persons bank to advise payment made in error. go and see the citisens advice and they will tell you the same

why on earth did you not check in april that the standing order had been cancelled? You must have a very healthy bank balance not to realise that £300 was missing and not accounted for. I know if that kind of money went from my account, I would notice the next day.At least you should have checked they had recieved your letter. I take it the bank is saying they "Never received" your letter? so not their fault?
You need to fight this one through the banking ambudsman I think, banks are so quick to take your money but not pay back whats your's. Good luck!

I imagine it all comes down to whether you can prove thet you sent the letter asking them to stop paying your Landlord.

If you can, then they definitely have to pay you back.

May I suggest you move to a bank that uses online banking? Then you can easily change standing orders etc. without any of this hassle.

Do you have a copy of the original letter that you sent to the bank? Keep telephoning until you speak to someone with the authority to refund or even go into a branch with a copy of the letter. The problem with many banks is that all queries go thorugh to a call centre and the staff there do not have the authority to do anything. Legally I am not sure how you stand - probably better if the letter was sent recorded delivery. The law surrounding direct debits is far clearer and more in favour of the customer.

YOU RECORDED THE LETTER OF COURSE?? IF YOU DID,YOU HAVE NO PROBLEM.THE BANK MAY STILL HAVE YOUR LETTER,OR A RECORD OF IT,OTHERWISE IT,S A LESSON LEARNED.IF NOT RECORDED DELIVERY,YOU CANNOT PROVE THEY EVEN GOT THE LETTER.

If you have some sort of record from the bank that they received this notice from you then you can most likely recover the money. If you do not, I imagine the bank can say that they never received such a notice and were simply doing what they were suppose to do.
i would try to track down the landlord and if is a decent person he will give you your money back.

UNLESS YOU CAN PROVE THE BANK RECIEVED THE LETTER YOU HAVE NOT GOT A CHANCE CLAIMING OF THE BANK (even if you have proof of posting you still require proof of delivery so if it was not sent recorded delivery you have no legal right to claim or blame the bank).
Your only chance is to find the landlord of the house if he as not sold the house in the meantime contact the land registry they will have the landlords address, and even then you will have to rely on his good nature to obtain your money back without a lot of trouble. contacting his bank will be a good idea give them a letter with the details and they will probably forward it to him for you but they will not give you any details like his address they are bound by law not to divulge any information to you or anyone else. trying to claim the money back from the bank will not work either the only person that can authorise withdrawals is your ex landlord so you will still be in the same position as you are now.
contactin g the CAB will be a complete waste of time they will only tell you exactly the same as I have just stated.

a solicitor may help you in finding the landlord but the cost may be more than the money you are trying to recover so before going down that road check first

Go and see your local CAB - they'll be able to tell you your rights and if they have someone who specialises in this type of action they will be able to contact your bank for you. Hope this helps. x
