If you filed bankruptcy doesn't that give you freedom from worry until after the bankruptcy is settled? If you had to file then you may have to relinquish property. |

no. if the bank won't talk to you about refinancing, or changing your payments, or restructuring your loan then you're pretty much out of luck.
If you DON"T talk to your lender you're crazy. With all of the foreclosures going on they'll bust their butt to keep you in your home and your payments on schedule.
Call them and ask them. If they say no, you're no worse off, but I'm betting they'll say, come in, lets fix this. |

If you filed - and that is your primary a CH 13 restructures your debt to get you current. You will be required to make the existing payment once the court consolidates the past due debts. You will have to pay ALL secured debts in FULL PLUS the BK Trustee payment for the back (late) bills under the BK protection.
If you can not make the existing mortgage payment PLUS the BK trustee payment BK will not save your home from foreclosure. =( |

The only person who can help you at this point is the lender. You need to contact them and ask what you can do to get out from under this. Ask if you can tack the 5 months in arrears to the back of the note, etc.

I hope that you have called your lender to explore all of the options. You need to ask yourself if you can really afford to stay in your home. Do you have a plan for managing your finances differently than before? Could you sell your home quickly to an investor? Will anyone consider a purchase and lease back situation?
If you are interest in sell, you might call the people at HouseBuyerNetwork.com to see if they have any affiliates in your area who could sell your house quickly or purchase it for cash.
