Does my fiance have to be there for closing on our new house.?
My fiance and I are closing on our first home next week. I told my realtor several weeks ago that we do not want a Wednesday or Friday closing because he is out of town on business during those days. Well...of course she forgot and scheduled the closing for next Wednesday. If we change the date, the lawyer will charge a $150 "re-draw fee". To make matters worse, he works in another office 100 miles away on Thursdays. We would have to drive there. I believe he'd have to sign a Power of Attorney paper naming you for this one time signing.

My husband was out of state during a closing and that worked for us. The realtor should know what would be best as these things do come up all the time.

First of all, having the lawyer do this is BS. I have never heard of a redraw fee. The loan docs are sent the day of settlement and the rest of the papers are on the computer. The day you settle doesn't matter to them.

Yes, you can get a power of attorney for your boyfriend. This allows you to sign for him. No big deal. The realtor should have a form and it will need to be notary.

Only if you included him on the deed. If he is on the deed, then his signatures will be required as well.

If the mortgage is going to be in both your names I think they have to be there to sign.

Reschedule the closing if you can for those exact reasons. Tell the Realtor they have to pay the "re-draw fee" out of their commission on the house. That is the least they can do. Since you told her ~ and she forgot it's her fault !!!

You have a couple of choices. You COULD have your fiance sign a legal Power of Attorney document allowing you to sign on his behalf for this and this ONLY situation. OR, if the paperwork is already prepared, nothing prevents him from signing where required and having those portions notarized.

When I bought an investment property and didn't pay attention to my wife's business travel schedule, I used the limited Power of Attorney document. I had to do a LOT of writing and signing, but the lender was fine with the POA.

he can sign a limited power of attorney for you to sign for kim. I would reschedule and make the realtor pay since she screwed up.

The signing of documents provides the opportunity to declare whether the property will be "community property" or not. In other words... if you divorce and your name is the only one on the deed you stay with the house.

I sincerely hope it does not come to that.

We could not attend ours at all and we signed something to make our realtor our legal representative and she signed for us. I would ask about it. It happens a lot.
