It depends who's name is on the lease and/or deed. If his is, yes, regardless of where he has been otherwise. If you are in the process of a legal separation, then there is a section in there over the division of the assets, and who keeps the residence.
If you are concerned about violence, get a restraining order, and change the locks. |

That is why it's a good idea to get a legal separation agreement, even if your state does not require one...it sets the stage for behavior and obligations until a divorce. |
