If his name is on the lease or if his name is on the title he can do whatever he wants. Is your name on the lease or title? If not, he can kick you out.

It depends who's name is on the lease and/or deed. If his is, yes, regardless of where he has been otherwise. If you are in the process of a legal separation, then there is a section in there over the division of the assets, and who keeps the residence.

If you are concerned about violence, get a restraining order, and change the locks.

he probably as the same rights as you have to enter the house unless a court as ordered otherwise he could be gone two years and still in theory have the right to enter unless you get a order from a court you will have to give a good reason to the court to get this type of order

If his name is on the title or the lease, he has the right to be there.

That is why it's a good idea to get a legal separation agreement, even if your state does not require one...it sets the stage for behavior and obligations until a divorce.
