If there is mold in my apartment (on the ceiling in the bathroom that I can actuall see and it's a huge patch) does the landlord legally have to bring in a mold inspector or an insurance agent to come and look at it? I live in Wisconsin if that matters at all. My landlord says that HE'S just going to come and look at it and when I asked him if he could inspect the whole apartment he told me that everything in there is less than a year old. So he basically told me no. I told him that my apartment feels really damp all the time and that my kids have been sick (cold and allergy symptoms) since we've moved into that place but he just disregarded it....what should I do? Additional Details We have two bathrooms and this one is the one with just a toilet and a sink....there is no fan or window in this bathroom. There's also an apartment above us so I don't know if it's something that's leaking down onto the ceiling in ours. I just makes me mad that he won't even have the place checked out at all..... |

I think we need more information.
Is there an exhaust fan in the bathroom, and if so does it get used every time someone takes a shower? If not, the likely reason for the mold is steam. Can you wipe it off with bleach water? If so, it is from steam. If not there could be a bigger problem.
Do you run your A/C to keep the humidity down in your apartment? Not just weather, but cooking/bathing/laundry add moisture to the air. |

This mold is more than likely a ventilation issue. Chances are if the ventilation is improved, the mold will also disappear. Usually, this kind of mold can be cleaned with a weak bleach solution. Is there a vented ceiling fan in the bathroom? If so, run it for about 1/2 an hour after you take a shower or bath. That should help alot. If the fan is not vented properly or is not of sufficient size for the bathroom, that is another issue to be fixed by the landlord. |

Ok....before you exaggerate the situation, understand that there is a difference between mold and mildew and BOTH are black and visually are identical.
All mold is NOT toxic mold.
Toxic black mold takes 3 things...heat, moisture and cellulose..so unless you have insulation in the paint on the ceiling inside your bathroom (which I can guarantee you don't), you don't have toxic black mold.
All mold and mildew will stink.
The #1 killer of mildew is bleach.
If you have children then they are probably around other kids, and that is most likely causing their illnesses, and unless they have a SPECIFIC allergy to mildew, they will not exhibit symptoms.
The easiest fix it to just clean it yourself...that is part of housekeeping. All you have to do is take a scrub brush, dip it in Clorox and scrub.....unless you would rather seek attention and blow it out of proportion.
PS: If you shut the bathroom door to shower, it has no fan, and there is no window ANYONE will get mildew in the bathroom ceiling.
If you do not run the air conditioning, you will ALWAYS have a damp feeling or even if you did, if the humidity level is high. |

What does your landlord intend to do after he looks at the mold. I can totally understand him wanting to take a look at it, but if isn't going to take any action there is a problem.
I would ask him to put in writting exactly what he is going to do.
I would allow him to visit the apartment and see if there is anything he can do.
I would withhold my rent and place it in an escrow account until he fixes the issue (check with your state, but in most states you can legally do this if you have a problem with your apartment).
I would also call the health department to understand what he has to do legally. He might not have to bring in a mold inspector if he can fix the problem. At the same time, you might be able to bring in your own mold inspector and charge him for it. |

You can actually get out of your lease if there are mold problems or anything that puts your or your health at risk. Hire a lawyer, call the health department, report it to the city or just go to your landlord with facts and if he doesnt want problems he will either get an inspector in (which is required) and get the mold taken care of A.S.A.P. or let you out of your lease. I would also ask to be refunded for the time you have payed rent and lived with the mold problem, show him doctor bills if you have them, you should be compensated for that. I lived in an apartment with black mold and when I found out and they didnt take care of the problem right away they let me out of my lease without problems when I told them I would call the health department and local news station. Apartments definately dont like bad publicity. |

OK.....your landlord is potentially poisoning you! Hell yeah he needs to bring in a professional and if he won't then report him to the Better Business Bureau or something. Make sure you document everytime you've asked him to come out AND take pictures. |

Your kids will continue to suffer and continue to develop worse symptoms unless you address the mold. If you can afford it your self I would pay to have it done, and make your landlord payback back the money or take it off your rent. You can also talk to your doctor to verify that it is the mold making them sick to prove it as well. In one hand it can cost you money and the other will be to subject your children to blood work, and possible and allergy test that put 50- 100 needles in there back. However, if your landlord does not fix the problem IMMEDIATELY I would take severe legal action Mold is not to be messed with and could seriously cause harm to your kids. |
