When I signed the lease and moved into my apartment 3 months ago, a refrigerator came with the apartment, and it worked fine. Well this week it broke. My landlord came over to inspect it, but doesn't know what is wrong or how to fix it. It is now day 4 without a refrigerator, and he is telling me that if his partner can't fix it tonite, then I should go out and buy my own refrigerator. I think that since the apartment came with a frig, he should continue to provide one- either fixed or replaced. I never would have moved in if it did not have a frig. |

In CA landlords do not have to provide refrigerators. They are appliances, like a microwave and are personal property of the landlord, not part of the house itself. It should be mentioned in the lease if it is covered. I know that some apartments provide them, but they are not standard and you whould have something about it in writing. |

I don't who's giving thumbs down on the correct answer, but like everyone stated the landlord is responsible for the fixing/replacing of appliances in the rental units UNLESS he specifies that the appliances are provided without warranty.
some rentals I draw up this type of lease and some I have the owner responsible.
Landlords can purchase a home warranty that will take away the landlord headaches. He might want to look into it.

being a landlord i know that we are suppose to provide u with working appliances,,if for ever reason either does not work,,,we either try to fix the problem by getting a refrigerator repairman to come in or replace it,,,if ur landlord tells u to buy ur own ,u should deduct it from the months rent and give him a copy of ur receipt along with a letter(copy for ur self)

I inspect apartment buildings for a living - I'm don't know how many units your community is, but your landlord should repair the fridge or buy a new one. You should not have to buy a fridge. I have never heard of it otherwise, but then again maybe it depends on the State in which you reside - but it's pretty standard for the landlord to be responsible for this. |

depends where you live....but what an ******!...does your LEASE( assuming you signed one) state that there is a fridge?...if so, point that out, offer to buy one and knock 75-100$ off the rent, or that he supplies one. or threaten to report him to the rental board. |

Yes, he must provide you with another refrigerator.
If he says you have to buy it, you can deduct the cost of purchase and delivery from your rent. |

I agree like everyone else that the landlord should replace the fridge. Tell him to stop being cheap. As long as you have been paying rent and everything else you should be entitled to everything that comes along with the home. If he gives you any trouble I would recommend letting officials know about this because it would be unfair of him to not replace it. I mean c'mon what if the A/C was broken does he expect you to pay for that too??? Plus, its not like it was your fridge, its actually his, why should he make you pay for something that belongs to him???I would also reread the lease to make sure there isn't any sort of clause or rule holding it against you. Good luck hopefully this landlord will comply and things will go smoothly for the both of you guys. =) |

Yes, it is your landlord's responsibility to replace the refrigerator, or at the very least reimburse you for buying another one, unless your lease came with some strange clause that says he doesn't have to. |

Unless your lease states that the unit comes with a refrigerator...then I'm afraid your out of luck. But then again...when you leave, you can and should take the fridge with you. |

Legally he probably is required to repair or replace, the reason he isn't in a hurry is that the job is a Pain in the butt (or wallet)
(All us Landlords are cheap; that's how we make our profit!)
In the 1st apt. I moved into, with my wife the absentee landlady
didn't want to provide one, legal but unusual,. I think she thought that we would go out and buy a nice bright shiny new apartment size one to fit ino the small space provided for it in the the small kitchen and leave it there for her, when we moved. We didn't; We picked up an old full size fridge at a yard sale for $75.00 and we still have it in our vacation home 20 years later!
2nd time the LL's unit died in the middle of the hottest part of the summer (like now) and we asked our LL if it was OK if we bought the unit we wanted instead of the cheapest one he could find, and we would take it when we left, (we ended up buying the place so we never had to move it) (he also never raised our rent in 10 years!) |

If it was leased with the refrigerator then yes he sould fix it or replace it unless there is a clause that says if it goes out then you get your own and take it with you when you leave.(That is what is in my lease) Someplaces come without appliances furnished but if they are there then owner is responsible for upkeep resulting from normal wear. If something breaks because of you doing something then its your cost. Refrigerators can go out anytime and its not something that is your fault so the owner should fix it or you can maybe come to a deal if they dont have the ready money where you buy one and they take it off of your rent. |

YES - anything that came with the apartment (stove / refrig / dw / tub etc) is legally his responbility.
write him a response letter and indicate that the refrig came with his property (apt) and it is his resp to replace. indicate that you in no way have any responsbity to pay for repairs to his property
also - if this continues you might contact the health dept. or your local Renters Rights Law Center
