Does the landlord have the right to check credit on both people living in the property?
I am looking to rent an apartment with my fiance, and we found the one that we like, but the landlord is asking for both our credit scores... is that leagal? or one is enough?

the landlord has the right to run a background check on every one over 18 years of age who will live in the unit if the wish, not all landlords will so if its a problem find one that will only require you to qualify

Thy can ask for all who will be signing the lease. What if one has bad credit and one has good credit, the two of you break up, and the one with good credit moves out?

Jennifer
Anyone wo will be signing the lease is subject to credit approval. It doesn't mean you won't be rented to, its a way of assessing risk.

Corozal
Yes it's legal because even if you decide (between you and your fiance) that only one will be paying the rent, your landlord can legally demand it from either of you, assuming the other person doesn't pay. They need to know how much of a risk any tenant is, even if there is more than one person in the building.

acermill
The landlord has the right to check the credit of all who will be signatories to the lease, and generally landlords require that all who will live in the premises be signers of the lease.

Of course, you will need to sign an authorization form allowing him to check the credit. If one of you refuses to sign, he can simply reject your application.

he has every right to check you both out if both are going to be in his place

It's legal to ask for both and he can expect that if one of you leaves, the other could handle the rent alone.

!!!
If both names are going on the lease then the landlord can legally ask for both credit scores.

Perfectly legal and he can pursue both of you if the rent is not paid.

Jim
yes the landlord has right to check on anyone on their property even dogs.

if you don't want to provide it, move on to another one who doesn't ask.

I'm sorry, I never heard of any landlord asking for anyone's credit score.

Most landlords ask for name, date of birth, age, present address and Social Security Numbers. THEN they submit the applicant's information to whoever they get their credit reports from and the score is on the report.

Thanks for asking your Q! I enjoyed answering it!

VTY,
Ron Berue
Yes, that is my real last name!
