vaireofthevalar | Does this sound legal? Ethical? |
I live in my my parents old home. It was my grandparents before theirs. It has been paid for, for a number of years. Originally we agreed to a purchase price of $15K for the substandard structure & the acre of land. Following Hurricane Rita, their insurance adjuster came out, totaled out the structure (I was present for the inspection, and ordered to be quiet) my parents were cut a check for almost $18K. They canceled the insurance on this property following that, and almost 2 years later, they are now back to demanding I pay them the $15K again. Are they not, in a sense, being paid twice, for one piece of land? Does it not border on insurance fraud?
Mind you, I did all the clean up and improvements to the land that they were compensated for already, and got nothing. Additional Details Basically, yes, we had a *gentleman's agreement* They inherited this piece of property, and it was always assumed I would as well, and the issue was never forced that I would have to pay for it. But they also led the insurance company to beleive they lived here as well. They have become quite greedy, and the fact is, they are not spending it, and they can't take it with them.. |

Lets see.....
You bought the substandard house and land for 15k.
Hurricane totally destroyed the house.
Parents were given 18k from the insurance company for the house.
Now they want 15k from you for just the land?
That does not sound correct. They essentially want 33k for a piece of land and a house that is no longer there that is/was only valued at 18k, right?
My question is how were they able to get the money and not you? I'm assuming that you never officially owned the house and it was still in your parents names. Correct?
If you are willing to let a relationship with your parents go to h*ll then I'd just let them keep the property and find somewhere else to live. That has really got to hurt that your parents would do such a thing to you. Money is an evil thing.
Best of luck! |

It is legal, perhaps not ethical.
Take yourself out of the picture, and represent the situation.
They get money from the insurance company for the structure. They are still entitled to sell it to another party.
However, since it is your parents, and you did the clean-up and improvements, they should take that into consideration. But there is no law that says they have to.
See if you can find out what one acre of land in the neighborhood is worth. One acre with no structure. Offer them that. Because they have already been compensated for the structure. Remind them that you are their kid and it would be nice if they gave you a break. |

If you bought the home from your parents HOW IN THE HECK DID THEY get the money from the insurance aduster? It would seem to me if you had paid for the house why did they carry the insurance. Your Parents are being extremely dishonest. Tell them you paid for it or making payments and if they press you tell them you will go to the authorities. I CAN NOT BELIEVE A PARENT WOULD TREAT AN OFF SPRING SO BADLY. They do not deserve you and if I were you whatever happens I would disown them immediately. They do not have a relationship with Jesus Christ or God I feel. God Bless you. Start living an honest life and leave them behind. Find God and pray for them. |

The insurance check was for the totalled structure, not the value of the property. If you want the acre, you are going to have to shell out the $15k. What improvements you have done to the property should be negotiated, but it sounds like (just IMHO) that this will be "expected" by your parents. I doubt they will be willing to compensate you for the work done. |

i agree with you. if you are the one who fixed the place up then they've already been paid. the money they received should have been used for repairs if they still planned on selling you the property. insurance money is for "compensation of loss" |

They were paid $18K for the structure. The land without the structure should be worth less than the land with the structure. However, they can ask what they want for the land even if the price is inflated. You should have been compensated fr the work you performed. Shame on you for trusting your parents. You could take them to court for compensation of labor but that's about it. |

No. You agreed to 15k to purchase the property. what they received from the insurance has nothing to do with your deal. You could always go purchase land from someone else. |
